� WHEREAS, tlie City of Orono is a municipal corporation organized and existing
� under the laws of the State of Minnesota; and

i WHEREAS,the City Council of the City of Orono (hereivafter"City Council")has
� , adopted subdivision and land development regulations for the orderly, economic and safe
1 development of land within the City; and �

{' WHEREAS,Kris Rudd (hereinafter the"subdivider")on behalf of Richard R.Rudd,
filed an application with the City of Orono(hereinafter"the City")requesting preliminary platting of
i a section of public road easement located on properly at 4575 Wayzata Boulevard West. The . .
• � property is legally described as follows: ,

�` The West Half of the West Half of the Northeast Quarter of the Southwest Quarter and the
east 148.50 feet of the Northwest Quarter of the Southwest Quarter all in Section 30,
Township 118,Range 23,Hennepin County,Minnesota.
(hereinafter"the property"); and

� WHEREAS,preliminary road plat approval was granted by the City Council on June
' 12,2000 and documented per the findings and conditions of City Council Resolution No.4479;and

� WHEREAS, the effective period of preliminary plat approval was extended via
� Resolutions No. 4905 and 5134; and
WHEREAS,the City Engineer has approved the road plans and�1ie grading,drainage
and erosion control plans; and .
WHEREAS,the subdividers have completed or have agreed to complete allplatting
requirements of the City of Orono and have requested final road plat approval. �
• NOW, THEREFORE, BE IT RESOLVED, that based on the findings of .

! Resolution No. 4479 the City Council of the City of Orono hereby approves the plat of CITY OF
� ORONO RIGHT OF WAY PLAT NO. 1, subject to the following conditions:
�
j1. The storm water retention pond shall be developed to NURP standards and be �
• protected by granting of a drainage and utility easement to ensure the area will not be
� developed, and drainageways are protected.
,
� 2. The road shall be dedicated as a public road and developed to standards established
j by the City of Medina,subj ect to a Joint Agreement to be executed between the cities •
j of Orono and Medina with regards to construction and maintenance of the road.Road
; construction can begin as soon as the Agreement between Orono and Medina has .
k been executed, and the final plat has been recorded with Hennepin County.
