WHEREAS, Gregory D. Gustafson and Jeanne S. Gustafson, husband
; and wife (hereinafter"the applicants") are the owners of the property located at 1280 and
'; 1290 Spruce Place within the City of Orono (hereinafter the "City") and legally described
. as follows:

� Lot 3, Block 10, SAGA HILL REVISED, Hennepin County, Minnesota
� � Lot 4, Block 10, SAGA HILL REVISED, Hennepin County, Minnesota .

(hereinafter the"property"); and
� WHEREAS, the applicants have made application to the City of Orono
' . for variances and a conditional use permit to Orono Municipal Zoning Code Sections 78-
� 330 (B) and 78-1250 to allow construction of a new residence on an existing lot 0.42
� acres in size when 1.0 acres is normally required, 100 feet in width at the shoreline and
` � 75 foot setback when 140' is normally required, and a conditional use permit to allow
j grading within 75 feet of the lake in order to remove the existing home and restore the
j site to match the existing grades and to remove the existing retaining walls.

' NOW, THEREFORE BE IT RESOLVED by the City Council of
Orono, Minnesota:

FINDINGS �
�
� 1. This application was reviewed as Zoning File#OS-3076.
t .
� 2. The property is located in the LR— 1B, One Family Lakeshore Residential
Distnct,which reqtures a mirumum lot area of 1.0 acres.
• 3. The Plaruung Commission reviewed this application at a public hearing
held on January 18, 2005 and recommended approval of the variances and
� conditional use permit based on the following findings:

a. The two lots are existing lots of record created prior to adoption of the
� current zoning regulations.
� b. A house has existed on Lot 3 since prior to the 1950's.

f a The existing home; which will be removed, is non-conforming with
� respect to the 75' setback from the lake and also hardcover within 75'
,
of the lake.
' d. The conditional use permit request is merely to remove the existing
' residence home and restore the site.

e. The proposed home will meet all setbacks, lot coverage,hardcover and
� ; building height regulations.
� f. The two lots will be legally combined in order to be considered as a
� ; single parcel for zoning purposes.

; 4. The City Council has considered this application including the findings
; and recominendation�of the Planning Commission, reports by City staff, �
� comments by the applicants and the public, and the effect of the proposed
; variance and conditional use permit on the health, safety and welfare of
� the community.
�
' S. The City Council finds that the conditions existing on this property are
i peculiar to it and do not apply generally to other property in this zoning
� district; that granting the variance and conditional use permit would not
j adversely affect traffic conditions, light, air nor pose a fire hazard or other
� danger to neighboring property; would not merely serve as a convenience
� to the applicants, but is necessary to alleviate a demonstrable hardship or
; difficulty; is necessary to preserve a substantial property right of the
�, j applicants; and' would be in keeping with the spirit and intent of the
Zoning Code and Comprehensive Plan of the City.

t CONCLUSIONS, ORDER AND CONDITIONS
�
� Based upon one or more of the above findings, the Orono City Council hereby
� grants variances and a conditional use permit to Orono Municipal Zoning Code Sections
' 78-330 (B) and 78-1250 to allow construction of a new residence on an existing lot 0.42
acres in size when 1.0 acres in normally required, 100 feet in width at the shoreline and
; 75 foot setback when 140' is normally required, and lastly a conditional use permit to
; allow grading within 75 feet of the lake in order to remove the existing hoine and restore
• the site to match the existing grades and to remove the existing retaining walls, subject to
' the following conditions:

i 1. Council approval is based on the site plan submitted by the applicants and
; annotated by City staff, attached to this Resolution as Exhibit A. Any
� amendments to the site plan which are not in conformity with City codes will
• � require further Planning Commission and City Council review.
i
f 2. Prior to issuance of a building permit, legal combination of Lots 3 and 4 shall be
` filed with the Department of Property Tax and Public Records at Hennepin
� County.
;

; 3. Five (5) foot drainage and utility easements shall be dedicated along the street and
j north and south side lot lines of the property.
�
� 4. The City Engineer must approve.a final grading plan prior to issuance of a
i building permit.
i .
5. Hardcover in the 0-75' zone shall not increase above the level of 0%. Hardcover
; in the 75-250' zone shall be limited to 2,737 s.f. or 25%per the proposed plan and
. hardcover allowance summary as depicted on Exhibit A. Applicants are advised
� that any future requests to increase hardcover will not likely be approved without
� concurrent reduction in existing hardcover.
t6. Applicants shall remove all plastic or fabric liner material from the decorative
� landscape beds on the property to ensure their permeability as non-hardcover �
t
surfaces.
• 7. Required removals of structure and hardcover shall be completed by the first
inspection for the proposed new residence.

8. Authorities granted by this resolution run with the property not with the
i applicants, but are permissive only and must be exercised by obtaining a building
; permit for the new construction within one year of the date of Council approval,
k or the variances and conditional use pernut will expire on that date (January 24,
� 2006).
� , 9. Violation of or non-compliance with any of the terms and conditions of this
� resolution shall constitute a violation of the zoning code, shall automatically
'4 terminate any authority granted herein, and shall be punishable as a misdemeanor.
� �
� 10. The undersigned applicants have read, understand and hereby agree to the terms
j of this resolution and on behalf of the applicants and the applicants' heirs,
� ; successors and assigns, hereby agrees to the recording of this resolution in the
i chain of title of the property.
