' A RESOLUTION GRANTING A VARIANCE
� TO MUNICIPAL ZONING CODE
� � SECTION 78-420 (B)

� WHEREAS, Anthony Thomas Homes, Inc., a Minnesota corporation,
(hereinafter"the applicant") is the owner of the property located at 400 Leaf Street within '
the City of Orono (hereinafter the"City") and legally described as follows:
i Lot 30, AUDITORS SUBDIVISION No. 230, Hennepin County,Minnesota
� . (hereinafter the"property"); and �

, WHEREAS, the applicant has made application to the City of Orono for a
lot area variance -to Orono Municipal Zoning Code Section 78-420 (B) to allow
� construction of a new residence on an existing lot 0.835 acres in size when 2.0 acres is �
� normally required.

NOW, THEREFORE BE IT RESOLVED by the City Council of

E FINDINGS
I
' 1. This application was reviewed as Zoning File#OS-3071. -
;
2. The property is located in the RR — 1B, One Farnily Rural Residential
District, which requires a minimum lot area of 2.0 acres.
� 3. The Planning Commission reviewed this application at a public hearing
held on January 18, 2005 and recommended approval of the variance
� based on the following findings:
�
# a. The lot is an existing lot of record created prior to adoption of the
current zoning regulations.
• b. A house has existed on the lot since prior to the early 1960's.
