Theproperty is located in the LR-1B, One Family Lakeshore Residential Zoning District which requires a minimum lot area of one acre and a minimum lot width of 140'. 3. The Planning Commission reviewed this application at a public hearing held on November 15, 2004 and recommended approval of variances based on the following findings: a. The property contains 15,679 s.f. or 0.36 acre in area and has 95' in width. b. The property was granted variances in 2001 for structural coverage and hardcover by Resolution No. 4644. • c. The proposed rebuild and reconfiguration of the lake side deck will not result in a net increase in structural coverage or hardcover within the 0-75' or 75'-250' setback.zones from those levels approved in 2001. d. The 2001 structure and hardcover removals resulted in an orientation of the deck which did not allow for safe staging in the pool area. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, a.ir nor pose a fire hazard or other danger to neighboring - property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive ; Plan of the City. r Page 2 of 5 o . 0 0 . ` ; CITY of ORONO - . RESOLUTION OF THE CITY COUNCIL ti kEsl'ig'G NO. `' .
