TO MUNICIPAL ZONING CODE �

� WHEREAS, G& L La�ld I�lvestments LLC, a liniited liability coiporation � •
, (hereinafter "the applicailt") is the owner of the property located at 2665 Mapleridge :
Laile within the City of Orono (hereinafter the"City") and legally described as follows:
Lot 6, Shore Hills, Hemiepin County,Mimiesota �
(liereinafter the"property"); and
• WHEREAS, the applicant has made application to the City of Orono for : �

� NOW, THEREFORE BE IT RESOLVED �by the City Council of

FINDINGS
1. This application was reviewed as Zoning File#04-3069. .
2. The property is located in the LR— 1B, Oiie Family Lakeshore Residential . �
District, which requires a minimum lot �area� of one (1) acre: The ; � �
applicant's property is 1.6 acres.in area. .
3. The Plaxuiing Commission reviewed this application at a public hearing
�- . ;::._�.-,held;.on:November;•1:5:, 2.004 and,recommended approval.of,the,variance _. ..
f � based on the following findings:
a. The existing deck is located within the average lakeshore setback.
• b. The adjacent lot to the east contains a pool located in front of the
average lakeshore setback.

c. A�small point exists along the sllore of the applicant's lot fiirther
. restricting the lake setback versus tlie lake setback on the neighboring _
lots. .
d. The most affected neighbor to the east has views primarily to the east
rather than across the applica�it's lot.
e. The neighbor to the west is nlinimally iinpacted as that house is
located closer to the sliore than the applicant's proposed house.
f. The applicaiit will meet all otlZer Zoning Ordinance requirements
including llardcover, lake/side/street yard setbacks, and lot coverage
by structures. � .
• 4. The City Cotuzcil has considered this application including the findings
aiid recornmendation of the Plaiuiing Commission, reports by City staff, .
con�unents by the applicant and the public, and the effect of the proposed
variance on the health, safety and welfare of the community.
5. The City Council finds that the conditions existiilg on this property are
peculiar to it and do not apply generally to other property in this zoning
district; that granting the variance would not adversely affect traffic
conditions, light, air iior pose a fire hazard or other danger to neighboring
property; would not merely serve as a conveiuence to the applicant, but is
necessary to alleviate a demonsirable hardship or difficulty; is necessary to �
preserve a substantial property right of the applicant; and would be in .
keeping with the spirit and iiitent of the Zoning Code and Comprehensive .
Plan of the City.

Based upon oiie or more of the above findings, the Orono City Council hereby
grants an average lakeshore setback variance to Orono Municipal Zoning Code Section
78-1279 to allow construction of a pool and associated decking in front of the average
lakeshore setback in conjunction with construction of a new residence, subject to the
. following conditions: .

1. Council approval is based on the site plan suUmitted by the applicant and
aiulotated by City staff,� attached to this Resolution as Exhibit A. Any.
aiilendmeiits to the site plan wluch are not in confornlity with City codes will
require further P1aiuling Corrunission and City Council review.
2. The pool and associated decking upon completion must not exceed an elevation of
945'.
3. The site grading shall be constructed in accordance with the City Engineer
recommeiidations.
• � 4. Autlzorities granted by this resolution nui witll the.property not with the applicant,
but are pennissive only and niust Ue exercised by obtaining a building permit for
the ilew constructioil witliin one year of the date of Couilcil approval, or the
variance will expire on that date (December 13, 2005). �
• 5. Violation of or non-compliance with any of the tenns and conditions of this
resolutioii shall constitute a violation of the zoning code, shall automatically
tenniiiate any authority granted lierein, and shall be ptuushable as a misdemeanor.
6. The undersigned applicant has read, understood and hereby agrees to the terms of
this resolution and on behalf of the applicant and the applicant's heirs, successors
and assigns, hereby agrees to the recording of this resolution in the chain of title
of the property.
