The Plaiming Conunission reviewed tliis application at a public hearing � ' held on Noveinber 15, 2004 and recornmended approval of the side ' setback variances based on the following findings: • a. The applicants'.property has 22,215 s.f. or %z acre in area and 90' of width at the sllore and 95' of width at the 75' setback. �, U. The applicants are proposing to reorient the rooflines; iio additioiial liviiig space is proposed within the substandard setbacics. • d. Due to the location of the home any additions or alteratioils to the west , � side of the house and detached garage require variaiices. ; • � e. CONCLUSTONS, ORDER AND CONDITIONS Based upon one or more of tlze above findings, the Orono City Council hereby �ants a variance to Orono Municipal Zoning Code Section 78-330 Subdivision B to allow side setbacks of 9.3' for the detached gara�e and 4.3' for the existing home in order to reorient the rooflines iii conjunction with a partial secoiid story additioii, a variance to : Orono Muiucipal Zoning Code Section 78-1288 Subdivision A to allow a second story to Ue consh-ucted over the exisfing home within 75' of the OHWL and hardcover xemovals, subject to the following conditions: 1. Council approval is based on the site pla.n submitted by the applicants and aiuiotated by City staff, attached to this Resolutioiz as ExhiUit A. Any . ainendments to the site plan which are not in conformity with City codes will require fiu-ther Plamiing Conimission and City Council review. 2. Hardcover in the 0-75' zone shall not increase above the level of 12.6%. Hardcover in the 75-250' zone sllall be liinited to 4,820 s.f. or 33% .per the � proposed plan and hardcover allowance summary as depicted on Exhibit A. Applicants are advised that a.ny future requests to increase hardcover or change the nature of existing/approved hardcover shall require City approval, and increases iil hardcover will not likely be approved without concurrent reduction in existing hardcover. 3. Applicants shall reinove all plastic or fabric liner inaterial from the decorative landscape beds on the property to ensure their penneability as non-hardcover surfaces. 4.
