A RESOLUTION
APPROVING THE PLAT OF
SPRING HILL ESTATES
-FILE #03-2961
WHEREAS,the City of Oroilo is a inutucipal corporation organized and existing under
the laws of the State of Minnesota; and .
WHER.EAS,the City Council of the City of Orono(hereinafter"City Council")has
adopted subdivision and land development regulations for the orderly,economic and safe development of
land within the City; and
WHEREAS,the City Council has coiisidered the application byNina Wright Wildman
• (hereinafter the"Developer"),a sulgle person,for subdivision ofproperiy located at 745 Spring Hill Road
and legally described as follows:
Exhibit A, attached
(hereinafter "the property"); and
WI�REAS,on Jauuaty 12,2004 the City Cotulcil adoptedResolutionNo.5099 grantulg
Preliminary Plat Approval for the proposed developinent of a three-lot plat for single familyresidential
purposes; asid
WHEREAS, the Developer has conlpleted or has agreed to complete all other
requirements of the platting regulations of the City includiiig:
1. Completion of all platting requireinents of Preliminary Plat Resolution No. 5099.
2. Dedication on the plat of perimeter Drainage and Utility Easements and Drainage
Easements as required iii Resolution No. 5099.
3. Designation and dedication on the plat of wetlands subject to City and other agency
jurisdiction, and granting of the standard Flowage and Conservation Easement over
• said wetlands inLots 1 and 2 and over those portions ofLydiard Lake perimeter wetland
located above the OHWL of Lydiard Lake.

4. Provision to the City of a storn7water manageinent buffer plan including defined buffer
areas to be maintained in permanent groundcover.
5. Submittal of Minriehaha Creek Watershed District (MCWD) pennit approving the
grading, drainage and stormwater management plan for development of the Property.
6. . Provision to the City of executed drainage easements over all drainageways and
established buffers within the plat.
7. Provisioil to the City of evidence that the property contaiiis no known significant
archaeological features that would require preservation.
8. Establislunent of covenants for each Lot for protection of draiilfield sites witlun each L,ot,
. including protective language for altemate septic sites aloilg with site plans locating both
• priinary and altemative sites;and including lauguage alertuig futt�re properly owners of the
need to protect sites on adjacent properties.
9. Provision to the City of an underlying Road and Utilities Easement for Outlot A.
10. Provision to the City of evidence of a private sha�ed driveway easement and covenants(via
a homeowners association or other inethod)for driveway maintenance over Outlot A in
favor of Lots 1, 2 and 3.
11. Provision to the City of an executed easeinent providing access for Lots 2 and 3 over �
Outlot B.
12. Provision to the City of a sigiied a�ld executed Developer's Agreement and letter of credit
for approved site iinprovements and construction of private loop road (Outlot A),
stornlwater and drainage facilities, etc.
13. Provision to the City of a title opiilion for the Property and certified copies of all
recorded easements currently affecting the Property:
14. Payment to the City of Stormwater and Drainage Trunk Fee in the amount of$32,400.00 �

NOW,THEREFORE,BE IT RESOLVED t11at based onthe find'uigs ofResolutionNo.
5099,the City Council of the City of Orono does hereby approve the plat of SPRING HII,L ESTATES,
Hennepin County,Minnesota subject to the following declarations and conditions:
1. A variance for lot width for Lot 3 is hereby gra.izted based on the findings noted
within Resolution No. 5099.
2. A variance is hereby granted to allow eiicroacYunent of aportion of drivewayhardsurface
• withui 75'of the OHWL of Lydiard Lake based on the findings noted witYun Resolution
No. 5099.
3. Lot 2 shall be exeinpt from meeting the 'average lakeshore setback' standards of
the Oroilo Zoning Code based on the findings noted within Resolution No. 5099.
4. Lots 1 and 2 are subj ect to City Shoreland regulatioiis regarding protection ofthe bluff
located on said Lots.
5. Setbacks for all principal residence construction shall be as depicted on the preliminaryplat
drawingbyMark S.Gronberg,a licensed surveyor of Gronberg&Associates,Inc.dated
December 5, 2003, of record in tlie office of the Planning Director.
6. All idenfified primary and altemate sewage system drainfield sites witlun the subdivisioil shall
be fenced offprior to any land alterations,and sucll fencing shall remain in place until such
time that each Lot is developed: -
� 7. The private ro ad loop in Outlot A is intended as a one-way counterclockwise circular
' access and when constructed sha11 be const�-ucted to Ciiyprivate road standards,with the
exception tliat the final design minimum paved width and clear area of such loop shall be
; subj ect to approval by the City Enguieer and City Fire Marshal to ensure adequate but not
• i excessive emergency vehicle access.

8. The private loop road in Outlot A shall be privately owned and iiiaintained per the

12. Tlle City Clerk shall release the plat doc�.unents for filu�g only upoii certification by the City �
Attoilzey and Platuliizg Director that all requiremeilts of the platting reg�zlations have been
satisfied. � •
13. The aforesaid plat sha11 be filed by the City of Orono wifh the Heiulepin CountyRegishar
of Titles Office on or before May 8, 2005 together with a cei-tified original copy of
this resolution and executed copies of tlze easements and covenants pertiizent thereto.
The approval gi.-anted by tlus Resolution shall expire if the conditions of tlus Resolution have •
not been met or the plat has ilot been filed by the date specified above. I�i that event,it will
Ue necessary to file a new application with the City of Orono for subdivision review.
