A RESOLUTION
EXTENDING THE EFFECTIVE PERIOD
OF RESOLUTIONS NO. 4845,NO. 4993, NO. 5059 AND NO. 5084
AND GRANTING AN AMENDMENT
TO CERTAIN CONDTTIONS OF RESOLUTION NO. 4845

� WHEREAS, WJM Properties, LLC, (l�ereinafter "the applicant") is owizer of the
� pro�erty located at 2605 Wayzata Boulevard West withiil the City of Orono (hereinafter"the City")
' and legally described as follows:
Exlzibit"A" attached,Hemiepin County,Miiulesota(llereii7after"the property"); and -
WHEREAS, the applicant has applied for an ameildment to and e:ctension of the
conditional use pennit and industrial site plaii approval originally grauted via City Council
• Resolutions No. 4845 adopted on August 12, 2002 aild modified via Resohrtion No. 4993 adopted
� June 9, 2003; Resolution No. 5059 adopted OctoUer 13, 2003; and Resolution No. 5084 adopted
! Noveilzber 24, 2003 ; and
! WHEREAS,the applicant has applied for an amendment to the�i�.dustrial Site Plan
� Approval granted via Resolution No. 4845 to allow revisioiis to the approved lighting plail for tlie
� easterly parking lot; and
� WHEREAS,the applicaiZt has requested a further extension of the effective period of
Resolutions No.4585, 4993, 5059 and 5084 to December 31,2005, due to delays caused primarily
� Uy conditions imposed by the Mixuiehaha Creek Watershed District related to wetland buffer and
� easeinent requirements,as noted in the applicai�t's letter of request which is part of the public record
; of application#04-3063; and .�
WHEREAS, after due published notice and �mailed notice in accordance with
Miruzesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on October 20, 2004 and November 3, 2004, at which times all
persons desiring to be heard conceming this application were given the opportunity to speak thereon.

1 NOW, THEREFORE, BE IT RESOLVED by the City Couiicil of Orono,
' Minnesota:
� FINDINGS
�
�
� 1. This application was revie�ved as Zoiiing File#04-3063.
2. The propei-ty is located in the(I)I�idusi�ial District.
� 3. The Oroiio Plaruling ConnZZission reviewed this application on October 20,2004 and
• ' on a vote of 7 to 0, reconzmended approval of extension of the timeframe for
applicant to nleet the coilditions of approval of Resolutions No. 4845, 4993, 5059
aizd 5084 to December 31, 2005; and after fiuther review of the application at a
continued puUlic hearing on NovemUer 3,2004 recoinmended approval oii a vote of
6-0 for an anzendinent of the existing CUP to allow for revisions to the approved
; lighting plan for the easterly parlcing lot, finding that the proposed lighting plan to
. increase from four 25-foot poles each with double-1000 Watt downcast shoe-box
style fixtures,to twelve such poles,will liave no si�nificant iinpacts on neighboring
; properties, and findiiig that such lighting is appxopriate for the uses approved for the
, property.
i 4. The City Council finds that the proposed increase in lighting under the proposed plan
will have minimal impacts on surrouiiding properties and is necessaiy to support the
uses approved for this site while being designed in a maiuler that will nzinimize direct
lighting spillover to sunounding properties.
', 5. Tl�e City Cotmcil fiilds that the basis for an extension of the effective period of
Resolutions No. 4845, 4993 and 5059 as presented by the applicant is a unique
circuinstance which supports the granting of the extensiou.
� 6. The City Couiicil has coizsidered this application inchidin�the findings and
recoininendations of the Planning Coinmission,reports by staff and comments of the
; applicant and the effect of the proposed use on the health,safety, and welfare of the
community.

� CONCLUSIONS, ORDER, AND CONDITIONS
i
� Based upon one or more of the above findings, the Orono City �Coulzcil hereby
approves ai1 extension of the effective period of Resohrtions No. 4585, 4993, 5059 and 5084 to
; Deceinber 31,2005;and hereby approves an amendment to the I�idusriial Site Plan Approval granted
; via Resolution No. 4845 to allow revisions to the easterly parking lot lighting plan to increase froni
; four 25-foot poles each with double-1000 Watt downcast shoe-box style fixtures, to twelve such
i poles, suUject to the followiizg conditions:
; 1. The berm and plantings for parlcing lot screening as required Uy Resolution No. 4845 aloilg
i the northerly and northeasterly periineters of the easterly parking lot sllall Ue installed�io later
� � than June 30, 2005.
�
� 2. The conditions of Resolutions No.4845, 4993, 5059 and 5084 shall remain in effect except
• 1 as rnodified by this Resolution. ;
� 3. The lighting plan is approved per the site and lightin�plans�attached liereto as Exhibit B,and
' any fiirther revisions to these plans nlay require fiirther City review and approval.

� 4. Tlle applicant is advised that the lighting plan herein approved is considered by the City to be
i the maximuin extent of lighting that will be approved for the easterly parking lot.
i5. Authorities granted by the conditional use pennit ruli with the property not with the
� applicant.
�
+ 6. Violation of or non-compliance with any of the terms and conditions of the conditional use
� pernlit approval shall constitute a violation of tl�e zoning code,shall automatically tenninate
any authority granted herein, and shall be puiushable as a misdemeanor.
7. The undersigned applicant and property owner has read, understands aud hereby agrees to
' the terms of this resolution and on behalf of himself,his heirs,successors and assigns,hereby
� a�rees to the recording of this resolution in the Chain of Title of the property. ,
