SECTION 78-1288 SUBDIVISION B AND DENYING
VARIANCES TO MUNICIPAL ZONING CODE
SECTION 78-1279 and 78-1288 SUBDIVISION A

WHEREAS, William A. Griersoii and Robin W. Grierson, husband and
wife (hereinafter "the applicants") are the owners of tlie property located at 1989
Fagerness Point Road within the City of Orono (hereinafter the "City") and legally
described as follows:
• Attached as Exhibit A aiid hereinafter the "property"; and ,} -

WHEREAS, the applicants have made application to the City of Orono
for a variance to Orono Municipal Zoning Code Sections 78-1279 and 78-1288
Subdivision A to allow constructioil of an addition to the western portion of the home to
extend into the 0 -75' setbacic from the OHWL of Lalce Miiuietonlca; and
WH�REAS, the applicants have inade application to the City of Orono
for a variance to Orono Municipal Zoning Code Section 78-1288 Subdivision B to allow
hardcover within the western 0 - 75' setback zone of 4% or 420 s.f. where 0% is ilormally
allowed anc� 7.3 % or 755 s.f. currently exists, and to allow hardcover within the 75'-250' .
' setback zone of 51% or 2,454 s.f. where 43% or 2,046 s.f. currently exists in order to
construct a covered front entry and a western lake yard addition to the existing home.
NOW, THEREFORE BE IT RESOLVED by the City Council of
Orono, Miiznesota:
FINDINGS .
1. This application was reviewed as Zoning File#04-3061. �
2. The property is located in the LR-1C, Single Family Lakeshore
Residential Zoning District which requires a minimum lot axea of 0.5 acre
• and a minimum lot width of 100'.

3. The Planning Coinmission reviewed this application at a public heariilg
held on October 18, 2004 and recoinmended approval of variai�ces to
Municipal Zoiiing Code Section 78-1288 Subdivision B based oil the
following findings:
a. The property has 0.48 acre or 21,217 s.f. u1 area and 130' at the lake
aizd 135' at the 75' setback on.the western lakeshore side and 69' at
the lakesliore and 104' at t11e 75' setback on the eastern lakeshore side.
b. The property is located on Fagerness Point Road and l�.as 0-75'
lakeshore on two sides.
c. There is no additional land available for acquisition by the applic�uzts
to make the property conforming.
• d. The proposal will not have a negative impact on light, air or open
space within tlle neighborhood.
. e. The proposed additions are not out of character for the inlmediate
neighborhood.
f. A portion of the westeni side of the existing home is located within �
75' of the OHWL of Lake Minnetonka.
g. A hardcover variance in the 75'-250' zone is supported by tlze
following hardships:
i. The proposal will result in a net reduction of 0-75' hardcover
on the western portion of the property of 327 s.f. or 3%.
ii. There is no additional hardcover that can be reasonably �
reinoved from the 75' —250' setback zone.
h. Each of the proposed additions will be constructed in a con£orming
location. '
4. The Planning Commission reviewed this application at a public hearing
held on October 18, 2004 and recommended denial of a variance to
Municipal Zoniiig Code Sections 78-1279 and 78-1288 Subdivision A to
• allow construction of an addition within the westerly 0-75' setback zone
based on the following findings:

a. The Planning Cominission c�id not find significant hardship to allow
new construction withiii 75' of the OHWL as the additions could be
coizstructed in conforming locations.
5. The City Council has considered this application including the findings .
. and recotnmendation of the Plaizning Coinmission, reports by City staff,
� comments by the applicants and the public, and the effect of the proposed _
variance on the health, safety and welfare of the community.
6. � The City Council finds that the coilditions eYisting on this property are
peculiar to it aizd do not apply generally to other property in this zoiiing
� district; that granting the variance would not adversely affect traffic
conditions, light, air nor pose a fire 1lazard or otl�er danger to iieiglzboring
� property; would not inerely serve as a convexuence to the applicants, but is
• necessary to alleviate a deinonstrable 1lardsl�ip or difficulty; is necessary to
preserve a substantial property right of the applicants; and would be iii
lceeping with the spirit aiid intent of the Zoning Code and Comprehensive
Plaii of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants variances to Orono Mtiuiicipal Zo�zing Code Section 78-1288 Subdivision B to
� allow hardcover witlun the western 0-75' setbacic zone for 420 s.f. or 4% where 755 s.£
or 7.3% currently exists and 0% is normally allowed and within the 75'-250' setbacic
zone for 2,448 s.£ or 51% hardcover where 2,046 s.f. or 43% cunently exists and 25% is
noimally allowed and denial of variances to Orono Municipal Zoning Code Sections 78-
1279 and 78-1288 Subdivisioii A to allow construction of home additions to encroach
into the 0-75' setbacic from the OHWL, subject to the following conditions:
1. Council approval is based on the site plan submitted by the applicants and .
annotated by City staff, attached to this Resolution as Exhibit B. Any •
amendments to the site plan which are not in conformity with City codes will
require further Planning Commission and City Council review.
2. Hardcover in the western 0-75' zone shall not increase above the level of 4% or
420 s.£, and hardcover in the eastern 0-75' zone shall not increase above the level
• of 26% or 1,431 s.f. (not including 864 s.f. of driveway which serves the property
to the south). Hardcover iil the 75-250' zoiie shall be limited to 2,448 s.f. or 51%

per the proposed plan and hardcover allowance summary as depicted on Exhibit
B. Applicants are advised that any futt�re requests to increase hardcover or
chailge the nature of existing/approved hardcover shall require City approval, and
' increases in haxdcover will not likely be approved witlzout concurreilt reduction in
existing hardcover. .
3. Applicants shall reinove all plastic or fabric liner material from the decorative
landscape beds on the property to ensure their penneability as non-hardcover
surfaces.
4. Required removals of structure and hardcover shall be coinpleted by the footiiig
inspection.
5. Authorities granted Uy tllis resolution run witll the property not with the
• applicants, but are perniissive only and must be exercised by obtaining a building
pennit for the new construction within one year of the date of Council approval,
or the variance will expire on that date (November 8, 2005). _
� 6. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and slzall be punishable as a misdemeanor.
7. The undersigned applicants have read, understand and hereby agree to the terms
of this resolution and on behalf of the applicants and the applicants' heirs,
successors and assigns, hereby agree to the recording of this r.esolution in the
chain of title of the property.
