Minnesota 55323•Municipal Offices On the North Shore of Lake Minnetonka December 14, 1990 Mr. & Mrs. David Jellison 2765 Kelly Avenue Excelsior, MN 55331 Re: Septic system setback - 4750 Creekwood Trail Dear Mr. & Mrs. Jellison: Steve Weckman and I have discussed all the communications we have had with you and your contractor and we felt that a letter of clarification is in order. The Orono septic system ordinances require a minimum 10* setback between septic tanks and any structure, including house, deck, patio, pool, gazebo, etc. However, in perhaps 30% of new installations we encounter, when the tanks are only located 10* from the house, other encroachments such as decks and patios often appear overnight and limit or eliminate reasonable access to the tanks. Therefore, we endeavor to suggest that structures be kept 20* away from the tanks to leave a buffer for future developments, although we can't legally enforce anything more than the 10* minimum. In discussing with your builder the existing location of the tanks, I have made it clear that there is no technical reason why the tanks cannot be moved to a location that won*t conflict with your pool/patio/gazebo plans. The only limiting factor is that if the sewer pipe leaving the house is at the west end, it probably would be a major undertaking to reroute inside plumbing to exit at the east end of the house. I hope this clears up any confusion we may have caused by giving you to apparently conflicting setback standards. If we can be of further assistance, please do not hesitate to call. Michael P.
