A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO WOODHILL COUNTRY CLUB �FOR A TEMPORARY OFFICE MODULE TRAILER FILE #04-3049 �VHEREAS, the City of Orono(hereinafter"the City")is a municipal corporation organized and existing under the laws of the State of Minnesota; and • WHEREAS, the City Council of the City of Orono has adopted zonulg and otlier regulations for the orderly, econoinic and safe development of land within the City; and � WHEREAS, Woodhill Co�miry Chib(hereinafter"applicant"or"the CluU"),a Mimlesota non- • profit corporation,is owner of the properly addressed as 200 Woodhill Road,aportion ofwluch is located withiil t11e City of Orono,such portion being legally described in Exhibit A attached and refened to hereinafter as "the Property"; and WHEREAS, the applicant has made application to the City for an amendinent of its 1968 conditional use permit(CUP)per Municipal Zoiung Code Section 78-418(4)to allow the temporary placeinent and use of a modular office trailer for a period of 9 moiiths during remodeling of the main Club facilities in Wayzata. � NOW,THEREFORE,BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zonin�File No. 04-3049. 2. � ThepropertyislocatedwitliintheRR 1BSingleFamilyRuralResidentialZoningDishict. 3. Woodhill Country Club operates under a CUP originally granted by the City on September 13, 1968. B) The proposed temporary placement and use of a inodular office trailer during remodeling of the Club's main facilities in Wayzatarequires an amendnient ofthe � Club's umbrella CUP because it teinporarily establishes a use not covered under . the existing CUP. C) The trailer will be located along the west side of the "temlis banl", a site . . approximately 450'from the nearest properiyboundary and inore than 600'from the nearest residence.Onlyminor grading will benecessaryto establish a level pad for the trailer. • D) During the club remodeling,club functions are expected to be reduced to relatively low levels,with nununal food services and office activities operatnlg out of the tenius bam and temporary office trailer.It is anticipated there willbe no new impacts on neighboring properties as a result of the relocated office activity. E) The trailer is intended to be in place for a period not to exceed 9 months,with removal expected by the end of June 2005. F) The trailer will not have pluinbing, as the tennis barn provides this necessity. � CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings,the City Council of Orono,Minnesota hereby grants to Woodhill Country Club an amendment to its 1968 Conditional Use Permit to allow the teinporary placement and use of amodular office trailer for aperiod of 9 months duringremodeling ofthe main Club facilities in Wayzata, subject to the following conditions: - 1. The trailer will be required to meet any applicable building code and handicap accessibility standards similar to a construction trailer, and shall not be used as a residence. • 2. Authorities granted by this conditional use permit run with the property not with the applicant. 4. Violation of or non-coinpliaiice with any of the ternls and conditions of this resolution shall constit�ite a violation of the zoiung code,shall automatically tenninate any autliority�anted herein, and shall Ue punishable as a misdemeanor. 5.
