A RESOLUTION
APPROVING THE PLAT OF
BOBWHITE MEADOWS
FILE NO. LA24-000056
WHEREAS,the City of Orono (hereinafter the"City") is a municipal corporation
organized and existing under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono (hereinafter"City Council") has
adopted subdivision and land development regulations for the orderly, economic and safe
development of land within the City; and
WHEREAS,the Steve White (hereinafter the"Developer") is the owner of the
properties addressed 4375 and 4246 Bayside Road within the City of Orono (hereinafter the
"City") also identified as PID's 06-117-23-12-0009 and 06-117-23-11-0003 and legally described as
shown in Exhibit A (hereinafter the"Property");
WHEREAS on May 21, 2024, the Developer applied for Preliminary Plat approval to
subdivide the Property into three(3) buildable lots.
WHEREAS, at its regular meeting on July 8, 2024, the Orono City Council
granted approval for the Preliminary Plat per the findings and conditions of Resolution No. 7488
by a 5 to 0 vote; and
WHEREAS, on October 14, 2024, the Developers applied for final plat approval.
The final plat application was deemed to be substantially complete on January 21, 2025; and
WHEREAS, the Developers have agreed to comply with all conditions of
Resolution No. 7488 and has completed or has agreed to complete all other requirements of the
platting regulations of the City.
NOW, THEREFORE, BE IT RESOLVED, based upon the findings of Resolution
No. 7488, the Orono City Council and the City of Orono does hereby approve the plat of
BOBWHITE MEADOWS, Hennepin County, Minnesota (a copy of which is attached as Exhibit
B), subject to the following conditions:
1) Development within BOBWHITE MEADOWS is subject to the Conclusions, Orders and
Conditions enumerated within Preliminary Plat Resolution No 7488 dated July 8, 2024.
2) Dedication on the plat of the perimeter Drainage and Utility Easements as required in
Resolution 7488.

3) The approvals granted in this Resolution shall become effective only when all conditions of
approval requiring actions by the Developers have been satisfied.
4) Minnehaha Creek Watershed District (MCWD)-approved permits for the grading, stormwater
management facilities, storm water pollution prevention plan (SWPPP) and erosion control
plan shall be submitted as needed.
5) A title opinion for the Property and certified copies of all recorded easements currently
affecting the Property have been submitted.
6) An executed trail easement has been provided.
7) The properties are not within the MUSA and will be served by private water supply wells and
septic systems.
8) Payment of Development Fees Required: Total: $20,410.81
a. Final Plat application fee: $550 (2024 application fee).
b. Park Dedication Fee: $3,710.81.
c. Stormwater and Drainage Trunk Fee: $16,120.
9) The City Clerk shall release the plat documents for filing only upon certification by the City
Attorney, Community Development Director, and City Engineer that all requirements of the
platting regulations have been satisfied.
10)According to City Code Section 82-142, the aforesaid plat shall be filed by the City of Orono
with Hennepin County within one year of Council approval (on or before March 10, 2026),
together with a certified original copy of this resolution and executed copies of the
easements and covenants pertinent thereto.
11)Violation of or non-compliance with any of the terms and conditions of this resolution may
result in the termination of any authority granted herein.
ADOPTED by the Orono City Council on this 10th day of March, 2025.

APPROVING A PRELIMINARY PLAT FOR
THE PROPERTIES LOCATED AT
4375 AND 4246 BAYSIDE ROAD

WHEREAS,Steve White,(hereinafter the"Applicant")has requested approval of a
subdivision of the property addressed 4375 and 4246 Bayside Road within the City of Orono
(hereinafter the "City") also identified as PID's 06-117-23-12-0009 and 06-117-23-11-0003 and
legally described as shown in Exhibit A:
WHEREAS,on May 21,2024,an application was filed with the City for preliminary
approval of a 3-lot residential plat of the Property;and
WHEREAS, after due published and mailed notice in accordance with Minnesota
Statutes 462.358 et. seq. and the City of Orono Zoning and Subdivision Codes, on June 17, 2024,
the Orono Planning Commission held a public hearing for the application at which time all persons
desiring to be heard concerning the application were given the opportunity to speak thereon;and
WHEREAS, on June 17, 2024 the Planning Commission reviewed the application
and recommended by a vote of 7 to 0 that the City Council grant preliminary plat approval;and
WHEREAS,the City Council reviewed the proposal at a regular meeting held on
July 8,2024,and hereby makes the following fmdings with regards to this application:
FINDINGS
1. This application was reviewed as Zoning File LA24-000028.
2. The Property is guided in the 2040 Orono Community Management Plan (CMP) for
single family residential use,specified as Rural Residential(1 unit per 2 acres)and Rural
Preserve (1 unit per 5 acres). The proposed development with single family homes is
consistent with the provisions of the CMP, and is consistent with surrounding
development.The Property is not located within the MUSA and will be served by septic
and private water.
3. The Properties are zoned RR-1A One Family Rural Residential District(5.0 acres)north
of Bayside Road. South of Bayside Road,the zoning is split between RR-1B One Family

A RESOLUTION
APPROVING A PRELIMINARY PLAT FOR
THE PROPERTIES LOCATED AT
4375 AND 4246 BAYSIDE ROAD

WHEREAS,Steve White,(hereinafter the"Applicant")has requested approval of a
subdivision of the property addressed 4375 and 4246 Bayside Road within the City of Orono
(hereinafter the "City") also identified as PID's 06-117-23-12-0009 and 06-117-23-11-0003 and
legally described as shown in Exhibit A:
WHEREAS,on May 21,2024,an application was filed with the City for preliminary
approval of a 3-lot residential plat of the Property;and
WHEREAS,after due published and mailed notice in accordance with Minnesota
Statutes 462.358 et. seq. and the City of Orono Zoning and Subdivision Codes, on June 17,2024,
the Orono Planning Commission held a public hearing for the application at which time all persons
desiring to be heard concerning the application were given the opportunity to speak thereon;and
WHEREAS,on June 17,2024 the Planning Commission reviewed the application
and recommended by a vote of 7 to 0 that the City Council grant preliminary plat approval;and
WHEREAS,the City Council reviewed the proposal at a regular meeting held on
July 8,2024,and hereby makes the following fmdings with regards to this application:
FINDINGS
1. This application was reviewed as Zoning File LA24-000028.
2. The Property is guided in the 2040 Orono Community Management Plan (CMP) for
single family residential use,specified as Rural Residential(1 unit per 2 acres)and Rural
Preserve (1 unit per 5 acres). The proposed development with single family homes is
consistent with the provisions of the CMP, and is consistent with surrounding
development.The Property is not located within the MUSA and will be served by septic
and private water.
3. The Properties are zoned RR-1A One Family Rural Residential District(5.0 acres)north
of Bayside Road. South of Bayside Road,the zoning is split between RR-1B One Family

TRAIL EASEMENT
AGREEMENT(this "Agreement") made effective this, j'er Day of ,
2025, by Steven C. White and Patricia L. H.White, husband and wife ("Grantor"), in favor of the
CITY OF ORONO, a Minnesota municipal corporation("Grantee").
WITNESSETH, that Grantor, in consideration of the sum of One Dollar($1.00) and other
good and valuable consideration given by Grantee,the receipt of which is acknowledged by
Grantee, does hereby grant, bargain, sell and convey to Grantee, its successors and assigns, a
perpetual easement for public ingress, egress and access for trail purposes and uses, including the
right to construct and maintain the same, together with the right of the public for access over,
above,under and across the land located in Hennepin County, Minnesota described as follows:
An easement for trail purposes over, under and across the southerly
12 feet of Lots 1 and 2, Block 1, BOBWHITE MEADOWS and the
Northerly 12 feet of Lot 1,Block 2,BOBWHITE MEADOWS,
according to the recorded plat thereof, Hennepin County, Minnesota
(the "Easement Area"): including,but not by way of limitation, a full and free right and authority
to enter upon the Easement Area to construct, install, maintain, operate and repair a gravel or
paved trail and any and all appurtenances incidental and related thereto (all of which are
hereinafter referred to collectively as the "Improvements). Grantee shall have the right to make
use of the Easement Area as is reasonably necessary and advisable for the construction,
installation,maintenance, operation and repair of the Improvements.
In addition to any other remedy Grantee may have,the covenants and restrictions
contained herein may be enforced by injunction.
Grantor covenants that it is in fee title to the Easement Area,has a lawful right and
authority to convey and grant this easement, and that the Easement Area is free from all
encumbrances that could adversely affect the easement rights granted herein, except any
encumbrance the holder has consented to this Agreement.
