RESOLUTION VACATING PART OF
CENTRAL AVENUE IN THE CITY
OF ORONO
ti%MREAS, the City_of Orono has received a petition dated July 5, 1977,
requesting vacation according to law of that part of Central Avenue abutting the
property of James Hartzell at 2987 Casco Point Road; and
WHEREAS, after due published and posted notice, a public hearing was
held on August 1, 1977, before the Orono Planning Commission when all interested
persons were given an opportunity to`be:heard; and
WHEREAS, no other property is affected by said vacation and no objections
were heard at the public hearing; and
WHEREAS, the travelled portion of Casco Point Road (Central Avenue) does
not pass over any land to be vacated; and
WHEREAS, the Planning Commission and City Council finds that the vacation
would place the legal right-of-way boundary consistent with topography and the
actual location of public and private improvements as maintained for many years; and
WHEREAS, the City of Orono will, retain sufficient right-of-way to insure
proper road, utility and drainage construction and maintenance; and
• WHEREAS, the City of Orono -finds it to be in the public interest to vacate
the portion of Central Avenue described herein;
NOW, THEREFORE, BE IT RESOLVED, that the City of Orono will vacate to
Mr. Hartzell for attachment to his property:
That part of Central Avenue, according to the recorded plat of Spring
Park, Lake Minnetonka, lying Southeasterly of the Northwesterly line of
Lot 88, said Spring Park, Lake Minnetonka, and its Northeasterly exten-
sion, lying northwesterly of the Southeasterly line of Lot 82, said
Spring Park, Lake Minnetonka, and its Northeasterly extension, and lying
Southwesterly of a line drawn parallel with and 30 feet Southwesterly,
measured at right angles, from the following described line: Commencing
at the most Westerly corner of Lot 103, said Spring Park, Lake Minnetonka;
thence on an assumed bearing of North 47 degrees 14 minutes 30 seconds
East along the Northwesterly line of said Lot 103 a distance of 95.74 feet
to the point of beginning of the line being described, said point being a
point in a non-tangential curve concave to the West having a radius of
445 feet; a tangent of said curve through said point of beginning bearing
North 15 degrees 56 minutes 30 seconds West; thence Southeasterly along
said curve through a central angle of 6 degrees 53 minutes 30 seconds an
arc distance of 53.52 feet; thence South 9 degrees 03 minutes East tangent
to said curve a distance of 200 feet; thence along a tangential curve to
the left having a radius of 280 feet and central angle of 37 degrees 40
minutes a distance of 184.07 feet; thence South 46 degrees 43 minutes East
a distance of 40 feet, and said line there ending.
This resolution will expire on March 1, 1978, if the aforesaid vacation has not
been filed with the Hennepin County Recorder's Office.. In that event, it will
be necessary to file a new application for vacation with the City.
