The legal department reported on the status
JOHN MORRISON COMPLAINT
of Mr. John M. Morrison's complaint relating
801 Tonkawa Road
to trees planted on Hennepin County right-of-
way which were removed during the sanitary
sewer 73-1 project. The Village Council
instructed the legal department to submit a
resolution for Council review and approval
at their next meeting, May 13, 1975.

RESOLUTION NO. 596
RESOLUTION DENYING APPLICATION
BY ARTHUR AHLM FOR BUILDING PERMIT
WHEREAS, Arthur Ahlm-has requested a building permit to
transform the existing house on Lot 4 and half of Lot 6, Block
6, Saga Hills into a garage and to build a new house attached
to the existing house on'that lot, and
WHEREAS, the lots are presently in an LR-1B.Use District
which requires minimum lot sizes of one acre and 140 feet in
lot width, and
WHEREAS, the lots do not meet the requirements of the
LR -1B Use District, and
WHEREAS, the present house therefore is a non -conforming
•
use,
NOW, THEREFORE, THE REQUESTED BUILDING PERMIT IS DENIED
FOR THE FOLLOWING REASONS:
1. The existing house is in a substandard lot and is
therefore a non -conforming use under Section 31.100 et. seq.
of the Zoning Code.
2. Section 31.100 et. seq. prohibits the expansion of
-pion-conforming uses when such an expansion will increase the
number of dwelling units or bulk of the building.
3. The applicant's plans show such a prohibited expansion.
4. There is no adequate access to the lot from the pub-
lic road.
5. To allow such an expansion would,be contrary to the
Zoning Code and the Comprehensive Plan of the City of Orono.
6.• Applicant's plans are a subterfuge to avoid the
requirements of the Zoning Code.
7. The existing structure is -patently not amenable to
transformation into a garage.

8. The proposed garage is an accessory building which
would exceed 1,000 square feet of floor and would therefore
be in violation of Section 31.330 of the Zoning Code.
9. The proposed expansion would constitute more than
50 percent of the fair market value of the structure and
therefore is prohibited by Section 31.102 of the Zoning Code.
The foregoing resolution represents the findings of fact and
action adopted by the council on April 22, 1975 by a vote of
three ayes and 0 nayes.
