HomeMy WebLinkAboutResolution 5867* t RESOLUTION NO. 586 A RESOLUTION DENYING APPLICATION FOR MARINA AND DOCS: LICENSE WHEREAS, the City of Orono enacted Ordinance No. 149 on July 9, 1973 which established a moratorium on the granting of building permits, rezoning applications, conditional or special use permits, variances or Qther authority for additional development in the City of Orono, and WHEREAS, this moratorium was extended by ordinance on several occasions and was not terminated until December 31, 1974, and WHEREAS, this moratorium was necessary in order -to insure the achievement of the goals of providing the city with satisfac- tory tools to guide development and to control development during the interim period so the benefits of proper planning would not be lost, to preserve the status quo pending the adoption of the measures necessary to protect the health, safety and welfare of the citizens of Orono, and WHEREAS, the council had been advised that a rezoning of certain B-2 areas to a residential classification would be advisable as part of the pending comprehensive plan and compre- hensive rezoning including that property owned by the applicant, and WHEREAS, in order to fulfill the requirements of the com- prehensive plan as proposed and in order to insure the health, safety and welfare of the citizens of Orono, and WHEREAS, Mr. Stan Straley made an application on April 4, 1974 to operate a commercial marina and a commercial dock on property which was at that time used for residential purposes and which had been considered to be rezoned to a residential zone, and WHEREAS, the L.M.C.D: had placed a moratorium on the issuance of -multiple dock licenses, and WHEREAS, the Planning Commission informed Mr. Straley of the moratorium and tabled the application as provided for by the ordinance enacting the moratorium, and WHEREAS, Mr. Straley has asked that this application be considered now that his property has been rezoned to an LR -1C-1 residential district, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orono, Minnesota: 1. That the application for a license to operate a marina and a commercial dock is denied since the proposed uses are neither a permitted or conditional use for property located in the LR -1C-1 residential district. 2. That the proposed marina operation and commercial dock on the property would be contrary to the Comprehensive Land. Use Plan previously adopted by the city and the intents and purposes of the Zoning Code. • The foregoing resolution was adopted on April 8, 1975, by a vote of 3 ayes and 0 nays. Robert L.
