A RESOLUTION GRANTING STUBB'S BAY
MARINA A CONDITIONAL USE PERMIT
TO -SELL SOUP AND SANDWICHES
WHEREAS, Chapter 35 of the Orono Municipal Code
requires -that food.of any type may not be served in a "B-2"
Lakeshore Commercial District without first obtaining a con-
ditional use permit allowing- sale of :food, and
WHEREAS,-Chapter,35 of the Orono Municipal Code,
' as amended effective January 1, 1975, does allow the sale of
prepackaged food or food from vending machines by conditional
use permit and not.full course meals "or any food preparation
other than warming by use of an infra -red or micro -wave oven,"
and
WHEREAS, on,N.ovember 12, 1973,-a conditional use
permit was granted to Stubb's Bay Marina for one year only to
a' sell sandwiches, soup and non-alcoholic beverages only, but
not to serve full course meals;.and 1
WHEREAS, the Council granted a variance to the
morator.ium,and-granted an extension of this one year permit
to December --2,- 1974, and later extended the permit to February
25, 1975, in order to allow the applicant additional opportun-
itiesto show to the Council why the permit to sell sandwiches,
soup and non-alcoholic beverages should be renewed even though
the zoning amendment eliminated the sale of sandwiches and soup
as a conditional use in.a "B-2".;zone and even though the appli-
cant has no,�frvested right to a permit renewal under the terms
of the November 12, 1973 conditional use permit, and
WHEREAS, the Planning Commission after extensive.
review recommended that the Council grant a conditional use
permit for one year only to Stubb's Bay.Marina to allow the
sale of soup and sandwiches, but not full. course meals, and
WHEREAS, the Council has reviewed all the relevant
facts and has rev iewed.the staff's recommendations at several
Council meetings concerning the permit application,
