AUTHORIZING TAKING OF EAS MENTS IN LAND BY EMINENT DOMAIN FOR SANITARY SEWER PURPOSES SANITARY SEWER PROJECT 73-1 WHEREAS, the City Council has ordered preparation; of a resolution authorizing the taking of an easement in lard by eminent domain and the City Engineer has recommended the acqusi- tion of easements in land for sanitary sewer purposes at the locations hereinafter specified, and it appears to the Council that it is necessary that the City acquire such lands, therefore BE IT RESOLVED by the City Council of Orono: 1. That it is hereby determined that the taking in easement of the tracts and parcels of land set forth in paragraph. three (3) hereof is necessary for the public good in order that said tracts and parcels shall be devoted to sanitary sewer pur- poses. 2. That the City shall take by right of eminent domain for sanitary sewer purposes an easement in the lands des- cribed in paragraph three (3) hereof, and the City Attorney be hereby authorized and directed to commence proceedings in the District Court of Hennepin County for appointment of Commissioners to determine the damages, if any sustained by the respective owners of the parcels affected by such taking, as authorized by law, and 3. That the lands referred to above are more parti- cularly described as follows: DESCRIPTION OF EASEMENT: A 20 foot wide permanent easement for sanitary sewer and lift station purposes over, under, and across Lot 13 Partens Point First Division according to the plat on file in the Office of the Register of Deeds, Hennepin County, Minnesota. The center line of said easement is described as follows: Commencing at the southwest corner of said swot. 13, thence easterly along the southerly line thereof 1.73.0 feet to the point of beginning of the centerline to be described; thence northerly to a point on the northern- lire of said Lot 13, said point being 154.0 feet easterly of the northwest corner of said Lot 13 as measured along the northerly line of said Lot 1.3 and said • center line there terminating excepting therefrom the permanent structures thereon. And also a permanent easement for sanitary sewer and lift station purposes over, under, and across the northerly 20 feet of said Lot 13 excepting therefrom the perma- nent structures there n. And also an 80 foot wide temporary easement for sanitary sewer and lift station purposes over, under, and across said Lot 13 • lying 40 feet on each side of the above described center line excepting therefrom the permanent structures thereon. And also a temporary easement over, under, and across the northerly 50 feet of said Lot 13 excepting therefrom the per- manent structures thereon. Said temporary easement expires December 31, 1975. DESCRIPTION OF EASEMENT: A 20 foot wide permanent easement for sanitary sewer purposes over, under and across Lot 12 Partens Point First Division according to the plat on file in the Office of the Register of Deeds, Hennepin County, Minnesota. The center line of said easement is as follows: Commencing at the southwest corner of said Lot 12, thence easterly along the southerly line thereof 122.0 feet to the point of beginning of the center line to be described; thence northerly to a point on the northerly line of said Lot 12, said point being 148.0 feet easterly of the northwest corner of said Lot 12 as measured along the northerly line of said Lot 12 and said center line there terminating excepting therefrom the permanent struc- tures thereon. And also an 80 foot wide temporary easement over, under, and across said Lot 12 lying 40 feet on each side of the above de- scribed center line excepting therefrom the permanent structures thereon. And also a temporary easement over, under, and across the southerly 15 feet of said Lot 12 excepting therefrom the perma- nent structures thereon. Said temporary easement expires December 31, 1975.
