Curtis Anderson Construction Co., Inc., et al Case No. 83-8109 Dear Mr. Anderson: Enclosed please find a stipulation between the City of Orono and your client, Ideal Kitchens, Inc. It is important to the City that its two easements, a Flowage and Conservation Easement and a Road and Utilities Easement be retained regardless of the, outcome of this -mechanic's lien foreclosure proceeding. I am enclosing four original, identical stipulations. Please sign all four stipulations. I assume you will need two of these four stipulations, one for the court and one for your records. I would appreciate it if you would return the other two signed stipulations to me so I may have one for my file and forward one to the City. Should you have any questions, please contact me. DISTRICT COURT FOURTH JUDICIAL DISTRICT Court File No. 83-8109 STIPULATION WHEREAS, the City of Orono, a municipal corporation, 4.s a named defendant in the above-cited mechanic's lien foreclosure action upon pr-)perty described as Lot 3, Block 2, Countryside Manor; and WHEREAS, the City of Orono has an interest in the above-cited lot and block due to a Flowage and Conservation Easement filed September 1, 1982 as document #1479974 and a Road and Utilities Easement also filed September 1, 1982 as document #1479975, both documents filed with the Registrar of Titles; and WHEREAS, the two easements were recorded on Certificate #615779 which covered the entire plat of Countryside Manor; and WHEREAS, petitioner has filed a mechanic's lien upon Certificate of Title #626420 covering Lot 3, Block 2 Countryside Manor as of September 22, 1983, as document #1537075. NOW, THEREFORE, THE PARTIES STIPULATE that regardless of the outcome of petitioner's mechanics lien foreclosure action, Lot 3, Block 2 Countryside Manor shall remain subject to the Flowage and Conservation Easement and Road and Utilities Easement as cited above in favor of the City of Orono.
