WHEREAS, :Bergeson -Caswell Inc. and the Village of Orono entered into arbi-
tration regarding the dispute of the cost of item 1:3 of Section C of the. bid
on the contract entered into by Dergeson-Caswell Inc. and the Villaue of
Orono on November 9, 1970, for the construction of deep well #2 of the
Navarre eater System, Improvement 1970 D--1.
WHEREAS, the findings of the arbitrator states the Village of Orono
shall pay to Bergeson -Caswell the sum of 54,530.25 in addition to the
amount already paid to Bergeson -Caswell by the Village. Also, the Village
shall pay 40% of the administrative fee in the amount of $85.33 to
Bergeson -Caswell for it share of the fee -,previously advanced. by Bergeson -
Caswell, Inc. to the American Arbitration association. The postponement
fee of 430.00 should be paid to American Arbitration Assn., which the
Village incurred when we were forced to postpone the hearing for one week.
NOW THEREFORE IT I3 HEREBY RESOLVED "NIAT: This award is in full
settlement of all claims submitted to this arbitration.
Adopted by the Village Council of the Village oC Orono, 14innesota at a
regular meeting held June 12, 1972.
