RESOLUTION #445
A RESOLUTION ORDERING THE OWNERS OF A HAZARDOUS BUILDING
WITHIN THE VILLAGE OF ORONO TO CORRECT THE HAZARDOUS CONDITION
WHEREAS, James A. Christie is the record owner of certain real
property located at 584 Park Lane, within the Village of Orono, legally
described as follows:
Lots 1 and 2, Block 10; Minnetonka Summit Park,
according to the plat thereof on file or of record
in the office of the Register of Deeds in and for
said county.
WHEREAS, the building constructed on said real property is in
a dilapidated condition, has no water supply, has no sanitary facilities
and constitutes a health and fire hazard:
NOW, THEREFORE, BE IT RESOLVED, that pursuant to Minnesota
Statutes 463.1.6 the said James A. Christie is ordered to correct the
condition above described on the grounds that the condition is hazardous
within the meaning of Minnesota Statutes 463.15 through 463.26; and
BE IT FURTHER RESOLVED, that the said James A. Christie is
ordered to correct.the condition by razing the building.and filling in
the excavated area, or in the alternative, checking and rebuilding
as necessary the foundation, bearing walls and non-bearing walls,
replacing structural members which are weak, checking and replacing or
repairing the entire heating, electrical and plumbing systems as necessary
to bring them within the specifications of the Municipal Code of Orono,
and all window seals and doors should be repaired as necessary, and the
building should then be closed and secured or -occupied, within 45 days
from the date this order is duly served upon him; and
BE IT FURTHER RESOLVED, that a motion for summary enforcement
of this order be made to the District Court of Hennepin County, State
of Minnesota,:,:unless corrective action is taken by the -•said James A.
Christie or unless his answer is filed within the time specified in
Minnesota Statutes 463.18; and
BE IT FURTHER -RESOLVED, that the Village Administrator and
Village Attorney be, and hereby are, directed to prepare and serve this
order and take all other necessary action in accordance with this
resolution and in accordance with Minnesota Statutes 463.15 through
463.26.
