Dear Ms. Dussol:
I have discussed the matter of your request as set forth in your
letter of May 19, 1987 with the City Attorney.
In order to confirm the validity of the exclusive easement for
dockage and non-exclusive access easement over Lot 31, Coffee's
Addition to Shadywood in favor of your client's property, we would
recommend that ycu obtain current title information on Lot 31 to
insure that the easements were not extinguished at the time of the
1982 sale by the Eberhardt Realty Company to James and Helen Kramer of
1937 Fagerness Point Road.
If the easements are proven valid, the City of Orono would ask
that the following be completed and/or submitted to the City before a
permit can be issued for a new dock:
1. Approval of a joint use dock license by Orono and the Lake
Minnetonka Conservation District. The license application with
the City of Orono must include the following information:
a) List of a 1 1 other property owners with valid riparian
easement rights over Lot 31.
b) Survey locating each riparian land area and the
pedestrian access.
c) Dock plan for each riparian tract.
2. Approval by the LMCD of al l setback variances for the
proposed dock (10 feet side setback required from all side
property lines).
3. Approval by the City of a variance to permit an accessory
structure on a lot that does not contain a principal structure.
4. Submittal of executed covenants dealing with the upkeep and
control of multiple used lana area and shared dock areas.
