. A RESOLUTTON REGARDING THE USE
OF THE DAKOTA RAIL CORRIDOR
WHEREAS, the Heruzepin County Regional Railroad Authority(HCRRA)now has
ownership of the Dakota Rail Conidor; and
WHEREAS,the City of Orono has consisteiltly supported the preservation of the
corridor as a continuous public transportation conidor, and has supported the development of a
regional recreational trail along the eniire length of the corridor; and
�VI�EREAS, as the HCRRA has jurisdiction over the con-idor, and their niles apply to
the use of the conidor, the City will support the management of the conidor Uy the HCRRA to
• ensure the preservation of the coi7idor as a continuous puUlic transportation corridor; and
WHEREAS,the HCRR.A is in ihe process of developin�policies regarding the private
use of the right-of-way in the corridor; and
WHE�AS, on-going public use of the corridor, such as for a regional recreational trail,
will discourage unauthoi-ized encroachments onto the comdor for private uses; and �
W�iEY�AS, it is iinportant that any private use of any portion of the right-of-way in the
corridor be managed in a way that preserves the ability to use the entire colridor as a contimio�is
puUlic transportation corridor iii the firture; and
WI�ERE�iS, any private use of the coil-idor shotYld be n�anaged tluough a writteu
agreement that provi.des for the use on an interinl basis, Uut enables the HCRRA to tenninate tlle
agreement when the land is needed for a public transportation use; and
i��[E�.c�3, exceptions to this can be made where there are historically-used crossings
of tlie corridor for access to private properties.
1��W,�����OI�,�E �'Y'���L�IE�, that the Orono C'ity Council does l�ereby
� confinn .its s�il�port for the preservation of the Dakota Rail Con•idor as a continuous p�tblic
transportatio�l corridor, and for thc developmeilt of a regional recreational trail along the entire
length of the con-idor.

BE I7C FURTHER RIESOLVED that the City of Orono �vill work with the HCRRA in
its development of policies regarding the private use of the Con-idor.
