RESOLUTION VACATING EASEMENTS
FILE No. LA24-000070
WHEREAS, on December 23, 2024, Tom Ryan (hereinafter the "Applicant"), applied to
vacate an unused portion of an existing dedicated drainage and utility easement over the
property addressed 2195 Watertown Road, and legally described as Lot 2, Block 1,
Cumberland, Hennepin County, Minnesota (hereinafter the "Property").
WHEREAS, the drainage and utility easement were dedicated to the public at the time of
the Final Plat of Cumberland on April 22, 2024 by Resolution No. 7466; and
WHEREAS, the drainage and utility easements were dedicated over the proposed
footprint of a realigned drainage ditch which was under construction at the time of the Final Plat
approval; and
WHEREAS, upon review of the as-built grading plan for the drainage ditch it was noted
that the described easement area and the existing ditch did not align. A portion of the existing
realigned drainage ditch was not fully encompassed within the dedicated easement area.
Additionally, because of the misalignment of the easement, additional land not part of the
drainage ditch was encumbered by the dedicated easement. The Applicant is amenable to
granting the additional easement to the public to correct the misalignment as part of their
request for vacation of the unnecessary portion of the easement; and
WHEREAS, Exhibit A describing and depicting the easement to be vacated, attached to
this Resolution No. 7563 is true and correct and are incorporated into and made part of this
Resolution; and
WHEREAS, pursuant to Minnesota Statutes § 412.851 and the Orono City Code, on
February 18, 2025, the Planning Commission of the City of Orono conducted a public hearing
preceded by two (2) weeks published and posted notice, and mailed notice to the abutting
property owners, to consider the vacation of the unnecessary easement; and
WHEREAS, following the hearing and consideration of the proposed vacation, the
review of the Zoning File#LA24-000070, and the recommendation of the Planning Commission,
the Orono City Council has determined that the unnecessary portion of the easement is not
needed for public purposes.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orono that the
unnecessary portion of the drainage and utility easement is hereby vacated subject to the
Applicant providing an executed drainage and utility easement to cover the remainder of the
drainage ditch prior to recording.
ADOPTED by the Orono City Council on this 10th day of March, 2025.

VACATION IN LOT 2, BLOCK 1, CUMBERLAND
DRAINAGE & UTILITY EASEMENT TO BE VACATED
Those parts of the drainage and utility easement dedicated in Lot 2, Block 1,
Cumberland described as follows: Commencing at the most westerly corner of said Lot
2; thence on an assumed bearing of South 19 degrees 25 minutes 35 seconds East
along the westerly line of said Lot 2 a distance of 18.40 feet; thence North 89 degrees
38 minutes 08 seconds East a distance of 5.29 feet to the east line of the west 5.00 feet
of said Lot 2 and the point of beginning of the easement being vacated; thence
continuing North 89 degrees 38 minutes 08 seconds East a distance of 20.76 feet;
thence South 59 degrees 06 minutes East a distance of 69.80 feet; thence South 37
degrees 03 minutes 30 seconds East a distance of 197.00 feet; thence North 54
degrees West a distance of 93.00 feet; thence North 37 degrees 16 minutes 41 seconds
West a distance of 93.51 feet; thence North 58 degrees 48-minutes 35 seconds West a
distance of 66.85 to said east line of the west 5.00 feet; thence North 19 degrees 25
minutes 35 seconds West along said east line of the west 5.00 feet to the point of
beginning.
