CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> ti� r, �•�` NO. 7563 <br /> t4kESHOfr <br /> CITY OF ORONO <br /> HENNEPIN COUNTY, MINNESOTA <br /> RESOLUTION VACATING EASEMENTS <br /> FILE No. LA24-000070 <br /> WHEREAS, on December 23, 2024, Tom Ryan (hereinafter the "Applicant"), applied to <br /> vacate an unused portion of an existing dedicated drainage and utility easement over the <br /> property addressed 2195 Watertown Road, and legally described as Lot 2, Block 1, <br /> Cumberland, Hennepin County, Minnesota (hereinafter the "Property"). <br /> WHEREAS, the drainage and utility easement were dedicated to the public at the time of <br /> the Final Plat of Cumberland on April 22, 2024 by Resolution No. 7466; and <br /> WHEREAS, the drainage and utility easements were dedicated over the proposed <br /> footprint of a realigned drainage ditch which was under construction at the time of the Final Plat <br /> approval; and <br /> WHEREAS, upon review of the as-built grading plan for the drainage ditch it was noted <br /> that the described easement area and the existing ditch did not align. A portion of the existing <br /> realigned drainage ditch was not fully encompassed within the dedicated easement area. <br /> Additionally, because of the misalignment of the easement, additional land not part of the <br /> drainage ditch was encumbered by the dedicated easement. The Applicant is amenable to <br /> granting the additional easement to the public to correct the misalignment as part of their <br /> request for vacation of the unnecessary portion of the easement; and <br /> WHEREAS, Exhibit A describing and depicting the easement to be vacated, attached to <br /> this Resolution No. 7563 is true and correct and are incorporated into and made part of this <br /> Resolution; and <br /> WHEREAS, pursuant to Minnesota Statutes § 412.851 and the Orono City Code, on <br /> February 18, 2025, the Planning Commission of the City of Orono conducted a public hearing <br /> preceded by two (2) weeks published and posted notice, and mailed notice to the abutting <br /> property owners, to consider the vacation of the unnecessary easement; and <br /> WHEREAS, following the hearing and consideration of the proposed vacation, the <br /> review of the Zoning File#LA24-000070, and the recommendation of the Planning Commission, <br /> the Orono City Council has determined that the unnecessary portion of the easement is not <br /> needed for public purposes. <br /> 1 <br />
