HomeMy WebLinkAbout03-10-2025 Petition LID Forest Lake - Opposition I was at the Feb 24th meeting to present our opposition to the Lake Improvement District in Forest Lake. I feel the information shared tonight is necessary as Orono will soon be asked to consider LID's in other bays. This will also tie into your consent agenda#11 for the LID created under Denny Walsh in 2017. Minnesota DNR "In short, LID's are a special purpose type of government"and are always under the governance of the city or county with jurisdiction. State of Minnesota 6115.0980 Subp. 2. Legal responsibilities and liabilities of lake improvement districts. Nothing in these parts shall be construed to relieve a lake improvement district of the legal duties,obligations,or liabilities incident to the programs, plans, or actions of the district. The lake improvement district shall assume all legal risks and,liabilities, including those for damages or any injury to persons or property, arising from the construction, operation;maintenance,alteration,or abandonment of its programs,'plans,or actions. In the event of termination of the district,or failure of the district to meet its obligations, these responsibilities and liabilities shall fall upon the unit or units of government which established the lake improvement district. Subp. 3. Limited"state liabilities. The establishment of a lake improvement district shall not impose any liability upon the state of Minnesota, its officers,employees,agents,or consultants,for any damage or injury to any persons or property resulting from the activities of the;lake improvement district. LMCD Presentation Eric Evanson presented at the LMCD board meeting on 2/12/25. Paraphrased from his presentation " He wants more LID's without putting more treatment costs on public agencies". He also suggested the use of DiQuat for treatment. In Forest Lake he suggested the use of either Diquat or ProcellaCOR. See attached pages and areas highlighted. Summary We reject the idea of private citizens taking on any financial and/or legal responsibility to manage "a public body of water". We as lakeshore owners should not be asked (or petitioned to do so)to operate in this capacity. We ask that our city rejects the formation of LID's and their liabilities as well. Diquat information found via"Gooale" Diquat was ultimately banned in the EU and the UK because of the"high risk" it posed_to residents and passersby near the fields where it was sprayed. But EU safety officials also cited concerns about the risks posed to farmers working with the chemical. Dec 8,2024. Al Overview Yes,diquat can be harmful to humans. It can cause skin and eye irritation,and can be toxic or fatal if swallowed, inhaled,or absorbed through the skin. Acute effects • Skin and eyes:Severe irritation,including eye damage,nosebleeds,and cracked skin • Gastrointestinal: Nausea,vomiting,diarrhea • Nervous system: Neurological disorders,tremors,convulsions • Lungs:Acute pulmonary edema, lung damage,and pulmonary fibrosis • Kidneys: Renal failure • Liver: Hepatic injury Long-term effects • Eyes: Cataracts • Skin:Cracked skin Is diquat toxic to fish? Laboratory tests indicate walleye are the fish most sensitive to diquat,displaying toxic symptoms when confined in water treated with diquat at label application rates.Other game and panfish(e.g. northern pike, bass,and bluegills)are apparently not affected at these application rates. Is diquat harmful to dogs? Diquat exerts most of its harmful effects in the gastrointestinal tract.Signs of kidney damage,central nervous system excitement,and convulsions occur in severely affected animals. Paraquat has 2 phases to its toxic action after ingestion. What are the side effects of diquat? Diquat can lead to severe irritation of the mouth,throat,esophagus,and stomach,and nausea,vomiting, diarrhea,severe dehydration,and disruption of fluid balance,GI discomfort,chest pain,kidney failure, and hepatotoxicity.Very large doses can lead to tremors and convulsions. https://www sciencedirect.com/science/article/abs/pii/S0147651317305031 The quaternary ammonium compounds diquat(DQT2+)and difenzoquat(DFQT+)are used today as post- emergence herbicides and desiccants in different types of crops(Perez-Ruiz et al., 1994, Rytwo et al., 2004).They have similar chemical and physical properties such as high solubility in water and high binding potential (Brian et al., 1958, Matolcsy et al., 1998).These herbicides are considered toxic for humans in their cationic forms(Reigart and Roberts, 1999)and are classified by the World Health Organization(WHO)as moderately hazardous(Class II),with a lethal dose(LDso)for oral ingestion in rats of 231 and 470 mg kg-1 for diquat and difenzoquat, respectively(World Health Organization,2009).The contamination of waters with these compounds is a real problem,since they can be easily dissolved in aqueous medium due to the previously mentioned high solubility in water.Therefore,the development of novel strategies for their removal from aqueous medium is needed.
