A RESOLUTION GR.ANTING .
PRELTMINARY APPROVAL OF A
CLASS III SUBDIVISION FOR
PROPERTY LOCATED AT
801 TONKAWA ROAD
FILE NO. OS-3073
WHEREAS, David R. Pomije and Joaiin Pomije (hereinafter the "subdividers")
on December 20, 2004, filed a formal subdivision application with the City for approval
of a two lot residential plat of property legally described as:
� Lot 1, Auditor's Subdivision No. 217, Hennepin County,Minnesota
• (hereinafter"the property"); and
WHEREAS, after due published and mailed notice in accordance with Minnesota
Statutes 462.358 et. seq. and the City of Orono's Zoning and Subdivision Codes, the
Orono Plaruling Commission held a public hearing on April 18, 2005, at which time all
persons desiring to be heard concerning this application were given the opportunity to
speak thereon; and
WHEREAS, at their regular meeting held on May 9, 2005, the Orono City
Council considered the subdivision application of the subdivider noting the following
findings of fact:
1. The property is located within the LR — 1B One Family Lakeshore
Residential Zoning District requiring a minimum of 1 acre of contiguous �
dry buildable land within each newly created lot.
2. The property contains a total of approximately 3.55 acres of land. There
are no wetlands on the property.
3. The proposed plat consists of two residential lots each meeting the
minimum lot standard requirements of the LR — 1 B, One Family
Lakeshore Residential Zoning District, each meeting the minimum 1.0
• acre lot area requirements and each having over 140' in defined width at
the shoreline and 75' setback.

4. Each lot will be served with municipal sanitary sewer and private wells.
The municipal sewer is available to both lots aiid the property has been
fully assessed for sewer.
5. Lot 1 contains the existing detached garage, guesthouse, tennis court and
other hardcover, which must be removed prior to filing of the final plat. ,
6. Lot 2 contains the existing house with attached garage, shed, pool and
other hardcover, which must be removed prior to filing of the final plat.
7. Lot 1 will have a separate access from Tonkawa Road, which will require
a permit from Hennepin County.
• 8. Lot 2 will be served off the existing drive access from Tonkawa Road.
Should this access be moved with construction of a new home, approval
must be obtamed from Hennepin County.
NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the
findings noted above, the City Council of the City of Orono hereby approves the
preliminary plat application of David R. and Joann Pomije at 801 Tonkawa Road per
preliminary plat drawings by Mark Gronberg of Gronberg and Associates, Inc., dated
March 16, 2005, subject to the following conditions:
1. Appropriate driveway permits shall be obtained from Hennepin County.
2. All existing structures and hardcover must be removed prior to filing of
the final plat. �
3. The developer shall grant to the City 10 foot drainage and utility
easements along perimeter property boundaries and 5 foot drainage and
utility easements along interior property boundaries.
4. An erosion and sediment control plan shall be submitted for City Engineer
review and approval prior to final plat approval.
• 5. Payment of standard Park Dedication Fee for Lot 1, Block 1.
6. � Payment of standard storm water and drainage trunk fee for the property. ,

7. Subdivider is hereby advised that preliminary subdivision approval will
expire within one year of the date of City Council approval, May 9, 2006.
Should the subdivider fail to complete the filing of the final plat
, application within the year deadline, it shall be necessary for the .
subdivider to file a new preliminaiy subdivision application with the City.
Final Plat Submittals:
The following list of final submittals must be submitted to the Zoning
Administrator two weeks prior to the regularly scheduled City Council meeting on the
second and fourth Mondays of the month. These submittals are as follows:
1. Record plat drawings in the form of two (2)mylar copies (one copy for the
• City's records and one for filing with Hennepin County) and one (1) copy
reduced to 1"=200'. Drawings to include:
a. Lot lines platted per preliminary survey by Mark Gronberg of
Crronberg &Associates, Inc., dated March 16, 2005.
b. Dedication of drainage and utility easements 10' wide along the
exterior boundaries of the property and 5' along the internal lot lines.
c. The naming of plat. �
� 2. Legal documents required:
a. Title opinion addressed to the City. All owners, mortgage holders or
others with property interest indicated therein shall sign the plat and all
other documents affected by such interest.
b. The applicant must provide certified copies of all recorded easements
currently affecting the property.
3. Fees to be paid: Total due: $18,878.00

b. Legal review and filing fees for subdivisoii and associated documents
_ $280.00
c. *Park Dedication Fee: Because the fair market value of Lot 1, Block 1
will exceed the threshold value of$69,375.00, the 8%pa.rk dedication
fee due is the maximum allowed fee of$5,550.00.
d. Storm Water and Drainage Trunk Fee = $ 12,798 (3.55 acres @
$3,605/acre) . .
4. Erosion and sediment control plan.
Adopted by the City Council of the City of Orono, Minnesota at a regular meeting
