RESOLUTTON DIRECTING STAFF TO
ISSUE A JOINT USE DOCK LICENSE
TO BOHNS POINT LANE HOMEOWNERS
SUBJECT TO CONDITIONS NOTED HEREIN
FOR THE PERIOD OF JANUARY 1, 2005 TO DECEMBER 31, 2005
WHEREAS,the City of Oroizo,hereiizafter"City"is a mtuucipal corporatioii organized and existuig
under the laws of tlle State of Muulesota and lias the authority and responsibility under Miiuiesota Statutes, State
Statuie 412,et. seq. and State Statute 462,et. seq.,to protect tlie health,safety,and general welfare of the citizeiis of
the City and ofher memUers of the public witluii the City; and �
WHEREAS, the City shares concuirent jurisdiction over the primary harbor limit of the City of
Oroiio with the Lake Miiuletoi�lca Conseivation District and the Departiile�it of Natural Resources of the State of
Mimlesota; and
• WAEREAS,ihe regulation of the iiavigable waters uivolves au exercise of police power of the State,
LMCD,a.nd the City of Oroiio, all of wluch have adopted niles to ensu're to all equal ezijoyiueilt of the public rights
aud equal protectiou fi oiil activity on or near tlie puUlic waters and on the laild witl�ul the City wluch,if uiu eg�.ilated,
iliay be detriiilental to the�uUlic health, safety aiid general welfare; and
. WHEREAS,the regi.ilatioiis of the DNR,LMCD, aiid tl�e Cii,y of Orono regulate the property rights
of tlie ripariari owiiers Uoth as to residential owners aud the conuiiercial mariiia owners to the extent proluUitulg any
� interference with the public waters adjoiiung their property. Tlie LMCD,DNR and City of Orono illust fulfill their
trusteeslup over the �uUlic waters by protecting agaiilst iizterfereiice by anyone, including those who assei-� tlle
coilunon law rights of ril�arian owners,whether or i�ot they be conuizercial nlarinas or residential owners;
WHER�AS, as to Lake Miimetonlca, a nnrtual right of eiijoyineilt exists Uetween alid is shared Uy
ri�arian owilers atid the public generally,no oile ii�aria��owiler lias exclusive�rivileges over Lake Muuietonlca. TUe
oilly ldditional private right that any riparian owner niay llave over tlie public generally is to coiistruct one dock to
ihe ilavigable depth of the puUlic waters. Tlzere can Ue no dispute Uut tllat ihe public generally and each riparia�l
owiler to Lake Miiuietoi�lca l�.as the iigtli to use the entire surface area of Lake Minuetonka for aIl suitable purposes
in con�noii with all other ripariau owners. Tlus right is a right ilot only to iilenlUers of the�ublic but tl�.e right to
e�.ch ripariau owiler.

rip�ri�ii users of the 111ce are regulated ii1 such a way as to ensure there is no abuse of the liiiiited riparian rights; and
WHEREAS, ihe City lias adopted reasonable regt.tlations regardiiig tl�e coizstruction and use of
lakeshore and dock facilities wlieiz such facilities are used uid niaintaiized Uy tl�ree or more fanulies, wliich
regulatioils iilclude the amival licensuig of Joilit Use Docks pursuant to Sectioi194-37 of the Oroiio Mtuucipal Code;
and
WHEREAS,filie puipose of tlus Resolution is to set forth the above noted general conditioiis aiid
coiiceilis and tlle following special conditioils as they relate to a.ii applicatiou for an aiulual Joiiit Use Dock License
described on ExhiUit A attached,
NOW, THEREFORE, BE IT RESOLVED, tlzat the City Cotuicil of the City of Orono hereby
�irects the Staff to issue a Jouit Use Dock Liceiise according to the facts a�.Zd coiiditions noted on Exlubit A attached.
Adopted by the City Council of the City of Oroiio at their nZeeting on the 11th day of April, 2005.

this license subject to revocation and/or prosecution for violation of Section 94-37 of the Oroiio Mtuucipal Code.

The dock structt�re or layout authorized by this liceilse s1ia11 be as shown o11 attached Exlubit B. Any clianges in this
layout sliall Ue subject to prior review and approval of the City Council.
N. SPECIAL CONDITIONS required for compliance with the ordinance of the City asid/or the LMCD. Tlie
issuance of this license is suUj ect to full conipliance with these conditioiis. Failure to coinply with these conditions
is cause for liceilse revocatioii andlor prosecutioil by the City.
1. The City acluiowledges the lustoric aild continued use of tlus three-slip multiple dock suice the
1960's for the benefit of three desiguated iion-riparian properties withiii the Bohns Point Addition.
2. Tlie City recognizes the easeinent over Lot 3,Block 1,Bohn's Point Addition to provide pedestrian
access to Outlot l, Bolm's Point Additioiz for the owners of Lots 1, 2, 5 and 6, Bohn's Point
Addition.
• 3. The three multiple dock slips are desigiiated for use by specific properties as spelled out below,and
no transfer of dock rights to different properties witlun the suUdivision of Bolui's Pouit Addition may
occur without City approval. Transfer of dock rights to any property outside the subdivision of
Bolni's Poiiit Addition or to any person who is not a Bolui's Poiiit Addition property owiier,will not
Ue allowed.Any boats stored at the dock sliall be owned by a properiy owner withul the Bohn's Point
Addition.

5. Tlus approval grants a 2005 Joiiit Use Dock License to the Association for tluee slips. Applicants
are advised of the iieed to henceforth apply for a City of Oroiio Joint Use Dock License annually.
V. Notl�ing in this liceiise shall confer upon any persoii for the Uenefit of aaiy property any vested right to use
Lake Miiuietonlca or the preinises iii a inamier penilitted Uy tliis resohrtion,but the use of Lake Mimietonka and the
