ISSUE A JOINT USE DOCK LICENSE �
TO PHEASA.NT LAWN HOMEOWNElt5 ASSOCIATION
SUBJECT TO CONDITIONS NOTED HEREIN
FOR THE PERIOD OF JANUARY 1, 2005 TO DECEMBER 31, 2005
� WHEREAS,the City of Orono,hereinaf�er"City"is a nituucipal corporatioil orgaiuzed aud exisfiiig .
utlder the Iaws of the Staie of Miiniesota and lias the authority a�id respoiisibilii;y under Miiuiesota Statutes, State
Stat�rte 412,et.seq. a.nd State Stahite 462, et.seq.,to protect tlie health,safety,and generai welfare of the citizens of
the City and other ilienlbers of the puUlic witluil the City; and
WHEREAS, tlie City shares concuirent jurisdiction over tlie prinlary harbor limit of the City of
Orono with the Lalce Muuletonlca Conseivatioii District and the Departinent of Nat�iral Resources of tlie State of
Muluesota; aiid �
• WHEREAS,the reg�.tlation of tlle navigable waters involves an exercise of police power of the State,
LMCD, aiid the Ciiy of Oroiio, all of whicli have adopted rules to eiisure to all equal enjoyiizeiit of the public rights
and equal protection fronl activity on or iZear tlZe puUlic waters and on tlie land witluil tlie City wlucll,if uiuegulated,
may be detriineiltal to the puUlic l�ealth, safety a.ild general welfare; and
WHEREAS,the regi,ilations of the DNR,LMCD,and the City of Orono regulate the property rights
of the riparian owners both as to residential owners aiid the coiiuilercial inarina ovsniers to the extent prolubitiiig auy
iiiterference with the public waters adjoiiung their properly. The LMCD,DNR aild City of Orono inust fiilf ll their
tntsteeslup over the public waters by protecting agaulst ulterfereiice Uy anyone, includiiig those who assert tl�.e
coiiuzioil law rights of riparian owners, whetller or not ihey be coi�uiiercial ilzarinas or residential owilers;
WHEREAS, as to Lake Mimletonlca, a mutual righfi of eiijoynle�it exists Uetween and is shared by
ri�ariau owners and the public geizerally,no one riparian owiler has e.cclusive�rivileges over Lake Muuletonlca. The
oi�ly additioiial private right that auy riparian owiier inay have over the public generally is to coiist�uct one dock to
the navigaUle depth of the puUlic waters. There ca.ii be iio dispute Uut that the public generally and each riparian
owner to Lake Miiwetoi�.lea lias tlie right to use tlie entire surface area of Lake Miiinetoi�lca for all suitaUle puiposes
iu conuzzon with all other riparian owiiers. This rigllt is a right not only to nieiilbers of the public Uut tlZe righl:to
each riplrial�owiler.
This nnitual right of eilj oyinent wluch is sl��red by ripariau owners aiid the puUlic geiierally includes the recreafiional
beiief ts of tlie lake such as boating uid fishing therein;tl�e riparian owiier has no exclusive privileges to these riglits;

WHEREAS, Lake Miilnetonlca is c�paUle of suUsi:antial Ueizeficial public use only as loiig as all
riparian users of the lake�re regulated in,stich a way as to eiistue ihere is no aUuse of the limited ripariaii righfis; and
WHEREAS, tlie City has adopted reasoiiable regulatioiis regardiiig the coustruction and use of
lakeshore aiid dock facilities when suc11 facilities are used a.nd maintained by tl�ree or more families, wluch
regulations include the aimual licensing of Joint Use Docks pnrsua�zt to Section 94-37 of tlie OroiZO Muiucipal Code;
and
� WHEREAS,the pu�ose of tlus Resohrtion is to set forth the above noted geileral conditions aiid
coiicenis and tlie following special coiiditioiis as they relate to aii application for au aiulual Joilit Use Dock License
described oil Exlubit A attached,
NOW, THEREFORE, BE IT RESOLVED, tliat the City Couiicil of the City of Orono hereby
•directs the Staff to issue a Joint Use Dock License accordiiig to the facts and eonditioils noted on Exlubit A attached.
