HomeMy WebLinkAboutResolution 369RESOLUTION #369 A RESOLUTION ADOPTING ASSESSMENTS FOR 1969LS-2 AND 1969LW-2 WHEREAS, proper notice of hearing has been duly given as required by law, by publication in the Mound-Westonka Minnetonka Sun on September 10, 1970, and WHEREAS,'the Clerk -Administrator has caused notice of the hearing on the proposed assessments to be served upon all persons owning property affected thereby by mailing a copy of such notice or personal service thereof, in accordance with Resolution #359, passed on August 24, 1970, the Village Council has met and heard and passed upon all objections to the proposed assessments for the following improvements and has amended the proposed assessments as it deems just: Imp. No. Nature Location of Assessable Areas 1969LS-2 Construction of All that land abutting, adjacent to Sanitary Sewer - or in the vicinity of the following Laterals streets and described property: 1969LW-2 Commencing at the NE corner of the SE 1/2, Section 36, Township 118 N, Range 23 W, thence W along the N line of said SE 1/4 to the NW corner of the -Hill -O -Way Manor.plat, thence S along W line of said plat to a point on the S right-of-way line of the ._ Minnesota -Western Railway, thence SEly along said S right-of-way line to the NW corner of the Allo Rae Terrace plat, thence S along W line of said plat to the S line of the SE 1/4 of said, Section 36 thence E along S line of the 'SE 1/'4` of S,_'ction 36 to the SE _ corner of said 1/4 section, thence N " along the E line of the said SE 1/4 of Section 36 to the point of beginning. -Generally known as... the Chevy Chase - Allo Rae Terrace area. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF ORONO, MINNESOTA: 1. Such.proposed assessments as amended for said improvement, copies of which are attached hereto and -made a part hereof., are adopted and shall constitute the special assessment hereby levied against the respective lands therein described, and each tract of.land therein included and assessed is hereby found to be benefited by the proposed improvement in the amount of the amended assessment levied against it. 2. Such amended assessment shall be payable in equal annual installments extending over a period of 15 years, the first installment to be payable concurrently with general taxes levied in the year 1971 and payable in the year 1971 and shall bear interest at the rate of eight percent (8%) per annum from the date'of the adoption of this assessment resolution. To the first installment shall be added. interest on the entire assessment from the date of this assessment until December 31st of the year in which such first -installment becomes due and payable. (Resolution #369, continued) To each subsequent installment when due shall be added interest for one year on the total of all unpaid installments. 3. The owner of any property so assessed may, at any time prior -to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the Village Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter pay to the County Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31st of the year in which such payment is made. 4. The Clerk -Administrator shall transmit a certified copy of this assessment as amended to the county auditor to be extended on the proper tax lists of the county, and such assessments as amended shall be collected and paid over in the same manner as other municipal taxes. Oberhauser, Mayor j Attest:Ralph H. artin, Cler - dministrator RESOLUTION-' # 3 70 'A RE'§OLUTION.AP'PROVING PLANS AND SPECIFICATIONS "' AND ORDERING ADVERTISEMENT FOR BIDS FOR 1970LW-1, ORONO MUNICIPAL WATER PROJECT WHEREAS, the Village Council by resolution dated May 25, 1970, authorized William T. Mills, the Village Engineer, to prepare plans and specifications of 1970LW-1, Orono municipal water project the (Improvement), WHEREAS, said plans and specifications are now on file with the Village Clerk in the Village Hall. NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Orono, Minnesota, as follows: 1. The plans and specifications for the Improvement prepared by William T. Mills of Orono, Minnesota, and now on file as stated above are hereby approved as the plans and specifications in accordance with which the Improvement shall be constructed, except as they may be modified by further action of this Council in accordance with law, and
