. A RESOLUTION VACATING
CERTAIN DRAINAGE AND UTILITY EASEMENTS
WITHIN THE PLATS OF
CRYSTAL CREEK; MEYER DAIRY ADDITION; .
� SPRUCE ACRES; ORONO OAKS; AND WOOD END ACRES
IN THE CITY OF ORONO,
HENNEPIN COUNTY, MINNESOTA
WHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
• WHEREAS, as part of the MnDOT Highway 12 relocation project, the
Minnesota Department of Transportation (MnDOT) acquired certain residential properties,
portions of which will become owned by the Burlington Northern and Santa Fe Railway
Company(BNSF) for railroad right-of-way purposes; and
WHEREAS, as part of the pending ownership transfer, BNSF has required
MnDOT to have existing drainage and utility easements vacated within the new railroad right-of-
way where they no longer have any public purpose; and
� ��ER�AS, on March 21, 2007, Lee Williams on hehalf o.f.MnDQT (hereinafter
the "petitioner") filed a petition and application with the City of Orono (hereinafter "the Eity")
requesting the vacation of certain portions of the Drainage Easements and�Drainage & Utility
Easements dedicated within Outlot B, CRYSTAL CREEK; within Lots 3, 4, and 7, Block l,
MEYER DAIRY ADDITION; within Lots l, 2, and 3, Block 1, SPRUCE ACRES; within Lots
1, 2, 3, 4, 5, and 6, Block 1, ORONO OAKS; and within Lots 1 and 2, Block l, WOOD END
ACRES; and
WHEREAS, the portions of said Easements to be vacated are formally and
legally described in Exhibit A attached hereto; and
WHEREAS, after due published and posted notice, a public hearing was held by
• the Orono City Council on Apri19, 2007 regarding said vacations and all interested persons�vere
given an opportunity to be heard; and

WHEREAS, after due standing and consideration, the City Council of the City of
Orono finds that said vacations as proposed are in keeping with the public interest and in
consideration of the following findings:
l. The portions of dedicated easements to be vacated no longer have a public benefit
• _ because the public drainage and utility purposes no longer exist; the approved
topographic changes within the railroad corridor have resulted in the obliteration,
removal or relocation of all pre-existing drainageways, wetlands, utility lines, etc. in the
area of the easements to be vacated. �
2. The vacation of said easements will not eliminate access to any adjoining or nearby
properties.
. 3. Utility companies have been notified of the proposed vacations and none have indicated
� opposition to the vacations.
4. The City does not intend to use tlie easements to be vacated for any future public
purpose.
` NOW, THEREFORE, BE IT RESOLVED, that the petition of MnDOT is
hereby granted by the Council of the City o£Orono and that the portions of easements as�legally
described and depicted in Exhibits A and B attached hereto, are hereby vacated.
Adopted by the City Council of the City of Orono, Minnesota at a regular meeting
held on April 9, 2007. .

� of record in the office of the County recorder in and for said county; thence
easterly on an azimuth of 103 degrees 35 minutes 15 seconds for 153.80 ,
. feet, along the boundary of said Monumentation Plat, to Boundary Corner
B23; thence easterly on an azimuth of 90 degrees 49 minutes 00 seconds
� for 705.11 feet to Boundary Corner M26 and there terminating; �
