A RESOLUTION GRANTING VARIANCES
� TO MUNICIPAL ZONING CODE
SECTION 78-305(B)
FILE NO. 07-3253
WHEREAS, Charles A. Cogbill a�id Jennifer A. Cogbill, husband and wife
(hereinafter "the applicants") are the owners of the property located at 1590 Long Lake �
Boule�ard within the City of Orono (hereinafter the"City") and legally described as follows:
Lot 12, Block 1, JOHNSTONS REARRANGEMENT OF ALBEES LONG
LAKE ADDITION Hennepin County, Minnesota (hereinafter the "property");

WHEREAS, the applicants h pp y
variance to Orono Municipal Zoning Code Section 305 Subdivision B to allow a side yard
setback of 21' where 30' is normally required�in order to construct a wider staircase to the
basement in their existing home.
NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
' FINDINGS � .
1. This application was reviewed as Zoning File 07-3253. �
' 2. The property is located in the LR — lA, Lakeshore Residential Zoning District
which requires a minimum lot area of 2.0 acres and a minimum lot width of 200'.
� . 3. The Planning Commission reviewed this application at a public hearing held on �
January 16, 2007 and recommended approval of a variance to allow a 22.5'side
setback based on the following findings: � �
. a. The property contains 21,403 s.f. in area and has 50' in width at the street and
69' in width at the 50'principal structure setback.
�
b. The lot is substandard in area and a residence has existed on the property for
many years.

c. There is no' additional land available to bring the lot�width or lot area into :
conformity. �
d. The only access to the basement of the existing home is substandard in width.
e. Including the addition, at 5.6%, the proposed residence is below the structural
lot coverage limitation of 15%. � .
f. The proposed addition complies with the front and rear yard setback � ,
requirements.
g. The lot is pie shaped and narrower as it approaches the street. The existing
home does not meet the 30' side yard setbacks. In order to meet the 30'
� � setback on both side yards the home would need to be situated at least 80' �
from the street,which is out of character for the immediate neighborhood.
. 4. The City Council has considered this application including the findings and ' �
reconunendation of the Planning Commission, reports by City staff, conunents by .
the applicants and the public, and the effect of the proposed variance on the �
health, safety and welfare of the community. .
5. The City Council finds that the conditions existing on this property are peculiar to .
it and do not apply generally to other property in this zoning di'strict; that granting
the variance would not adversely affect traffic conditions, light, air nor pose a fire
hazard or other danger to neighboring property; would not merely serve as a
convenience to the applicants, but is necessary to alleviate a demonstrable .
hardship or difficulty; is necessary to preserve a substantial property right of the
applicants; and would be in keeping with the spirit and intent of the Zoning Code �
and Comprehensive Plan of the City. ,
CONCLUSIONS, ORDER AND CONDITIONS � � ,
Based upon one or more of the above findings, the Orono City Council hereby grants a
variance to Orono Municipal Zoning Code Section 78-305 Subdivision B to allow a 22.5' side
yard setback in order to construct a 5' x 24' addition to the existing home, subject to the
• following conditions: •

1. Council approval is based on the site plan submitted by the applicants and annotated by
City staff, attached to this Resolution as Exhibit A. Any amendments to the site plan
which are not in conformity with City codes will require further Planning Commissioiz
and City Council review. '
2. Approvals are limited to the scope of the approved survey and building plans attached as
Exhibit A.
3. Applicants shall remove all plastic or fabric liner material from the decorative landscape
beds on the property to ensure their permeability as non-hardcover surfaces.
4. Required removals of structure and hardcover to be removed shall be completed prior to �
the footing inspection for the addition.
• 5. Authorities �anted by this resolution run with the propei-ty not with the applicants, but �
are permissive only and must be exercised by obtaining a building permit for the new
construction within one year of the date of Council approval, or the variance will expire
� on that date(February 12, 2008).
6. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
7. The undersigned applicants have read, understand and hereby agree to the terms of this
resolution and on behalf of the applicants and the applicants' heirs, successors and
assigns, hereby agree to the recording of this resolution in the chain of title of the
property.
Adopted by the Orono City Council on the 12`" day of February 2007.
