. A RESOLUTION GRANTING
VARIANCES TO
MUNICIPAL ZONING CODE
SECTIONS 78-1279, 78-350, 78-1403 AND 78-1288
FILE No. 06-3245
WHEREAS, Michael and Karen Maney, husband and wife, (hereinafter
"Owners") are the owners of the property located at 3605 North Shore Drive within the City
of Orono (hereinafter "City") and legally described as: Lots 11 and 12,.Auditors Subdivision
No. 273, Heiinepin County,Minnesota (hereinafter"the property"); and
_ WHEREAS, for the purpose of adding a second story to the existing residence
the Owners have made application to the City for a variance to Municipal Zoning Code
�� Section 78-1279 to allow a lakeshore setback of 42 feet when 75 feet is required and a three-
foot encroachment into the average lakeshore setback; and
WHEREAS, for the purpose of replacing the existing detached garage and
shed with an attached garage and adding a second story to the house the Owners have made
application to the City for a variance to Municipal Zoning Code Section 78-350 to allow a
private street setback of 0.0 feet when 30 feet is required; and
WHEREAS, for the purpose of constructing an attached garage, a decorative
wing wall and a�l oversized overhang the Owners have made application to the City for a
variance to Municipal Zoning Code Section 78-1403 to allow structural lot coverage of 22.9
percent when 15 percent is allowed; and
�VHERE�,.S, for the purpose of adding an attached garage and decorative wing
wall to the existing residence the Owners have made application to the City for a variance to
Municipal Zoning Code Section 78-1288 to allow 16 percent hardcover in the 0 to 75 foot
zone when none is allowed and to allow 61.4 percent hardcover in the 75 to 250 foot zone �
when 25 percent is allowed; and
� WI�EREAS, after due published notice and mailed notice in accordance with
Miruiesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on November 20, 2006, at which times all persons desiriilg
to be heard concerning this application were given the opportunity to speak thereon.

NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
� MimZesota:
. FINDINGS
1. This application was reviewed as Zoning File#06-3245
2. The property is located in the LR-1C zoning district, where 0.5 acre is the
minimum lot area and 100 feet is the minimum.lot width. The property is 0.26
. acre in area and 92 feet in width.
3. There is a roadway that provides access from this property and four others to
North Shore Drive. This roadway has existed for over 50 years. It is
maintained by the property owners who use it for access. While this roadway
does not have the 50 foot right-of-way required for a private roadway and in
• fact may exist only by prescription, it functions as a private roadway and
should be considered one for purposes of determirung setback and lot area.
This does not reduce the width of the lot but the area is reduced to 0.22 acre.
4. . The Planning Commission reviewed this application on November 20, 2006
and on a vote of 4 - 0 recommended approval of the variances, based on the
following findings:
a. The area of the lot is only 43 percent of the required minimum lot area. No
land is available to enlarge the lot. The size of the lot is similar in size to
the other lots in the immediate vicinity.
b. The new garage will be placed so the width of the private roadway/fire lane
at its narrowest point is increased from 15.2 feet to 18 feet. The new .
garage is slightly larger than required to accommodate two vehicles to
compensate for absence of a basement under the house.
� c. The second story will resemble a half-story. The remodeled house will
have less mass than a new 2%z story house constructed without a lot
coverage variance. The portion of the house that encroaches on the
average lalceshore setback will be changed from an enclosed room to an
open porch. �

5. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments
by the applicants and the public, and the effect of the proposed variance on the
health, safety and welfare of the community.
6. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variances would not adversely affect traffic conditions, light, air
nor pose a fire hazard or other danger to neighboring property; would not
merely serve as a convenience to the Owners, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the Owners; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.
• CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, tlle Orono City Council hereby grants variances to Orono
Municipal Zoning Code Sections 78-1279, 78-350, 78-1403 and 78-1288 to allow
� consti-uction of a second story, wing wall, and attached garage for the existing residence,
subject to the following conditions:
1. Council approval is based on the site and house plans submitted by the
Applicants and a.imotated by City staff, attached to this Resolution as Exhibits
A. and B. Any amendments to these plans may require further Planning
Commission and City Council review.
� 2. A fire lane shall be maintained across the property as generally shown on
Exhibit C. The northwesterly side will be marked with Fire Lane signs and the
� southeasterly side adjacent to the garage approach will be marked with
contrasting paving materials. A fire lane and emergency vehicle access
easeinent shall be provided over the fire lane. By signing this resolution the
Owners agree to �rant this easement, which shall be created by a separate
document.
� 3. The proposed open entry porch and the open porch on the lake side of the
house shall not be reconverted to enclosed space.

' 4. Hardcover ii1 the 0-75' zone shall be liinited to 1,017 s.f. or 16% and in the 75-
250' zone shall be limited to 1,099 s.f. or 61.4 %per the proposed site plan and
hardcover allowance summa�.y as depicted on Exhibit D. The Owners are
advised that any future requests to increase hardcover or change the nature of
existing/approved hardcover shall require City approval, and increases in
hardcover will not likely be approved without concurrent reduction in existing
hardcover. �
5. Owiiers shall not place any plastic or fabric liner material under a.ny
landscaping on the property to ensure their permeability as non-hardcover
� surfaces.
6. Authorities granted by this resolution run with the property not with the
Owners,but are permissive only and must be exercised by obtairiing a building
� permit for the new construction before January 22, 2008 or the variance will
expire on that date.
7. � Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, . and shall be punisl�able as a
misdemeanor.
. 8. The undersigned Owners have read, understand and hereby agree to the terms
of tlus resolution and on behalf of their heirs, successors and assigns, hereUy
agree to°the recording of this resohrtion in the chain of title of the property.
