NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File 06-3233. 2. The property is located in the RR — 1B, Zoning District which requires a minimum lot area of 2.0 acres and a minimum lot width of 200'. The Planning Commission reviewed this application at a public hearing held on September 18, 2006 and recommended approval of the conditional use permit for the land alterations and proposed shed based on the following findings: a. The applicant has met all City Engineer recommendations. b. All building setback requirements are met. c. No additional lighting, except that required by the building code, is proposed. d. The proposed storage shed will meet all building height requirements. e. The conditional use permit standards of Section 78-916 (a) (1-3) are met. 4. The Planning Commission reviewed the signage element of this application at a public hearing held on September 18, 2006 and recommended approval of the conditional use permit for a campus monument sign as well approval of the sign size variance, but recommended denial of the variance for height based on the following findings: a. The property is approximately 4.38 acres in area and has frontage along Ferndale Road North and County Road 6 (Sixth Avenue North). b. The current Orono Zoning Code does not have sign standards for institutional uses allowed conditionally within Residential Districts. Within Residential Districts a nameplate sign with a maximum of 12 s.f is permitted. c. The existing monument sign is outdated, and in disrepair; the new monument sign will be modern, larger, match the architectural style of the newly reconstructed church and will be easier to see and read from the intersection. The new monument sign will conform to Zoning Code Section 78- 1466(11) regarding monument signs, and will have total a sign face of 42 s.f. plus an emblem within the "gable end"of the sign area. 5. The City Council finds that the height variance for an additional 6" is appropriate for this site only because it will have the following characteristics which support its approval: a. The sign is located in compliance with the setbacks established within the Orono Sign Code and will have no negative visual impacts because of its height. b. The physical separation between the building and the sign is such that the additional 6" of height is an architectural scale characteristic that will allow for a visual consistency and connection between the church's steep roof pitch and the sign's design. 6. The City Council finds that the columbarium is a use similar to a cemetery and is not an allowed use in the RR-1B district, and therefore cannot be approved without an amendment of the zoning code. 7. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicant and the public, and the effect of the proposed conditional use permit on the health, safety and welfare of the community. 8. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the conditional use permit would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a conditional use permit per Orono Municipal Zoning Code Section 78-418 (3) conduct land alterations in the area between the church building and County Road 6, and to construct a 12' x 24' shed; and grants variances to Section 78-1467 to allow placement of a sign with 42 s.f. and 10'6"in height, subject to the following conditions: 1. Council approval is based on the site plans submitted by the applicant and annotated by City staff, attached to this Resolution as Exhibit B. Any amendments to the site plan which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Any additional lighting beyond that required by the Building Code will require approval of a separate conditional use permit. 3. Building permits are required prior to commencement of all of the aspects of the proj ect. 4. Prior to issuance of a building permit of the grading portion of the project the applicant will provide the City with a Developer's Agreement in lieu of a Letter of Credit for the improvements. 5. Any and all existing and forthcoming City Engineer recommendations shall be incorporated into the final plans. 6. The columbarium is specifically not approved because such approval absent an amendment of the zoning code would constitute a use variance which cannot legally be granted. 7. Authorities granted by this resolution run with the property not with the applicant, but are permissive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the conditional use permit will expire on that date (November 27, 2007). 8. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor.
