A RESOLUTION � APPROVING THE PLAT OF COUNTRYSIDE MANOR 3�ADDITION -FILE#06-3218 � WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and . WHEREAS, the City Council of the City of Orono (hereinafter "City Council") has adopted subdivision and land development regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application by Brian Arne and Julie Morrison-Arne, husband and wife, and Kerry and Kiann Nassauer, husband and wife � (hereinafter "Owners") for a re-plat subdivision of private property and vacated roadway located at or adjacent to 130 and 145 Manor Circle and legally described as follows: 130 Manor Circle (Morrison-Arne): Lot 1,Block 1, Countryside Manor 2"d Addition,Hennepin County,Minnesota � 145 Manor Circle(Nassauer): Lot 1,Block 2, Countryside Manor 2°d Addition,Hennepin County,Minnesota . The east and west halves of the vacated public road formerly known as Manor Circle as platted and dedicated within the plat of Countryside Manor 2"d Addition, Hennepin County,Minnesota (hereinafter"the Properties"); and � WHEREAS, on August 14, 2006 the City Council adopted Resolution No. 5495 granting conceptual approval for the vacation of Manor Circle as well as the vacation of certain existing drainage and utility easements, and granting Preliminary Plat Approval for a re-plat of the Properties to create a private road outlot with cul-de-sac, and increase the size of their individuallots; and WHEREAS, on November 13, 2006 the City Council adopted Resolution No. 5529 approving the vacation of Manor Circle as well as vacating certain drainage and utility • easements within Lot 1, Block 1 and Lot 1, Block 2, Countryside Manor 2"d Addition; and Page 1 of 4 , . o,�,. � � o � o , C ITY of ORONO . ,� - :- � , ti ti RESOLUTION OF THE CITY COUNCIL ��`qkESI3.04�G NO. 5.5.3 0 , . WHEREAS, the Owners have completed or have agreed to complete all other requiremeiits of tlze plattin�regulations of the City including: 1. Completion of all platting requirements of Preliminary Plat Resolutioii No. 5495. 2. Dedication on the plat of "draiiiage and utility easements" 10' along exterior property lines and 5' along the interior properry line perimeter as required in Resolution No. 5495: 3. Submittal of signed and eaecuted Road, Drainage and Utility Easement and Declaration of Private Covenants, Conditions, Restrictions and Private Roadway Easement for Maintenance of Same over the private road Outlot, or an alternate • maintenance provision meetin;the approval of the City Attorney. . 4. Provision to the City of a title opinion or other evidence of ownership satisfactory to the City Attorney and certified copies of all recorded easements currently affecting the Property. 5. Payment to the City of final plat review fees and legal review and filing fees in the amount of$530.00 as established within Resolution No. 5495. , NOW, THEREFORE, BE IT RESOLVED that based on the findings of Resolution No. 5495, the City Council of the City of Orono does hereby approve the residential plat of COLINTRYSIDE MANOR 3RD ADDITION, Hennepin County, Mirulesota subject to the following declarations and conditions: 1. The private road Outlot shall continue to be known as Maiior Circle and no addresses will be changed. 2. Manor Circle shall be privately owned and maintained. 3. The City Clerk shall release the plat documents for filing only upon certification by the • City Attorney and Plannin� Director that all requireinents of the platting regulations have been satisfied. The aforesaid plat shall be filed by the City of Orono with Hennepin County on or before May 13, 2007 together with a certified original copy of this resolution aaid executed copies of the easements and covenants pertinent thereto. The approval granted by this Resolution shall expire if the conditions of tlus Resolution have not been met or the plat has not been filed by the date specified above. In that event, it will be necessary to file a new application with the City of Orono for subdivision review. Adopted by the City Council of Orono this 13th day of November,2006.
