A RESOLUTION GRANTING VARIANCES TO MU1vICIPAL ZONING CODE SECTIONS 78-1288 AND 78-1436 FILE NO. 05-3146 WHEREAS, Mark R. Palm and Painela J. Palm, (hereinafter "the applicants") are owners of the property located at 1447 Park Drive withiii the City of Orono (hereinafter "the City") and legally described as follows: �i Lot 8,Block 15, Saga Hill Revised,Hennepin County, Minnesota (hereinafter "the property"); and WHEREAS, the applicants have submitted an application requesting variances to Municipal Zoning Code Section 78-1288 to permit 3,372 s.f. (33.6%) hardcover in the 75-250' � lakeshore setback zone where 3,812 s.f. (37.9%) exists and 2,512.5 s.f. (25%) is allowed; to permit 1,534 s.f. (48.6%) hardcover in the 250-500' lakeshore setback where 1,607 s.f. (50.9%) . exists and 946.5 s.f. (30%) is allowed; and a variance to Section 78-1436 to permit a S' setback where 15' is required for construction of a new 25' x 30' (748 s.f.) detached garage to replace an existing detached garage; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Plai�.niiig Commission held a public hearing oi� October 17, 2005, at which time the Pla��ning Conunission on a vote of 5-0 tabled the application and directed the applicants to draft a revised plan that would reduce the garage to 750 s.f. or less, relocate it at a 15' setback fiom the street and 10' froin the side lot line, orient it as side-loading, and provide a grading plaii for City Engineer review; and WHEREAS, applicants submitted a revised plan for an 800 s.f. (25x32) garage 18' from the street lot line and 5' from the side lot line. Planning Cominission reviewed the revised plan in January 2006 and on a vote of 5-0 recommended approval only to the extent of the 2002 approval, i.e. garage size less than 750 s.f., 5' setback, and hardcover as approved in 2002. The Council reviewed the revised plan on February 13, 2006 and tabled the application pending submittal of a new plan meeting the Planning Commission recommendation; and. • WHEREAS, a further revised plan was subinitted by the applicants and reviewed by the City Council on October 23, 2006. This application was reviewed as Zoning File#OS-3146. 2. The property is located in the LR-1B, Single Family Lakeshore Residential Zoning District where 1 acre is the minimum lot size and 140 feet is the minimum lot width. The lot is 0.39 acre in area and is 47.5' wide at the slioreline, 52' wide at the 75' setback, and 61' wide at the proposed garage location. 3. The Planning Commission reviewed the application for variances and recommended approval by a vote of 5 to 0 based on the following findings and � hardships: A. The lot was platted prior to current zoning standards. B. Property factors that make construction of a new garage conforming in location difficult include the topography, with a continuous downgrade � from the street to the house, with drainage that naturally runs to the property to the west; the narrow lot widlh; and the location of an existing boulder retaiiung wall. A side loading garage will leave a relatively flat area to maneuver vehicles and allow drainage from the street to bypass the buildings and house. C. The total distance between the new garage and the existing retaining wall will be 22'. A garage meeting the required setback would only leave 17' which is not adequate for safe backing of vehicles. D. A garage with direct access to the street would require fill to be brought in to raise the ground elevation and create a flat approach in front of the garage. It �vould not be feasible to have the driveway continue to slope down to the garage as winter conditions may cause a vehicle to slide into . the building. Additionally, the driveway design needs to be done to ensure that any water would be diverted away from the building. . According to Heruiepin County plat maps and the survey submitted with the application, there is a portion of Forest Lane (undeveloped) located between this property a.nd the lakeshore. It is assumed that this portion of Forest Lane will be combiiied witli tlie applicants' property at some time in the future. It has served as the lakeshore access for this lot. Other lots in the neighborhood have had Forest Lane vacated and a few lots have combined that portion of property with the residential site. For current zoning purposes, this lot is being considered a lakeshore lot for setback purposes even though the legal description and property records do not include the vacated portion of the road. Tlus is an important distinction for this property because a non-lakeshore lot would not permit an accessory building to be located closer to the street than the house. 4. The City Council finds that the conditions existing on this property are peculiar to � it and do not apply generally to other property in this zoning district; that granting the variances will not adversely affect traffic conditions, light, air, nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 5. The City Council has considered this application including the findings and recominendations of the Planning Commission, reports by City Staff, comments by the applicants and the effect of the proposed variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER,AND CONDITIONS � Based upon one or more of the above findings, the Orono City Council hereby grants variances to Municipal Zoning Code Section 78-1288 to permit 3,372 s.f. (33.6%) hardcover in the 75-250' lakeshore setback zone where 3,812 s.f. (37.9%) exists and 2,512.5 s.f. {25%) is allowed; to permit �1,534 s.f. (48.6%) hardcover in the 250-500' lakeshore setback where 1,607 s.f. (50.9%) exists and 946.5 s.f. Council approval is based on the site plaiz and building plans submitted by the applicants and annotated by City staff, attached to this Resolution as Exhibit A. Any amendments to said plans which are not in conformity with City codes or with this approval will require further Planning Coinmission and City Council review. 2. Hardcover in the 0-75' zone shall not be increased above the current level of 153 s.f. or 4.2%. Hardcover in the 75'-250' zone shall be reduced to and remain no greater than 3,372 s.f. or 33.6%, and hardcover in the 250-500' zone shall be reduced to and remain no greater than 1,534 s.f. or 48.6%, per the proposed plan and llardcover allowance surrunary as depicted on Exhibit A. Applicants are advised that any future requests to increase hardcover or change the nature of approved hardcover shall require City approval, and increases in hardcover will ` not lilcely be approved without concurrent reduction in existing hardcover. • 3. Applicants shall remove all plastic or fabric liner material, if any, from the decorative landscape beds on the property to ensure their permeability as non- hardcover surfaces. 4. Required removals of hardcover shall be completed prior to the first inspection for the proposed addition. 5. The applicants shall be subject to the recommendations of the City Engineer as noted in Tom Kellogg's letter of October 16, 2006. The west or rear foundation wall of the garage shall be extended downward to a depth that eliminates any need for a retaining wall along that 5' setback which will allow for the approved grading plan to be accomplished. 6. Authorities granted by this variance approval run with the property not with the applicants, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or these variances will expire on that date (October 23, 2007). 7. Violation of or non-compliance with any of the terms and conditions of this approval shall constitute a violation of the zoning code, shall automatically • terminate any authority granted herein, and shall be punishable as a misdemeanor.
