. A RESOLUTION APPROVING A SUBDIVISION
OF A LOT LINE REARRANGEMENT FOR PROPERTIES �
. LOCATED AT 500 AND 540 ORONO ORCHARD ROAD SOUTH

WHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, the City Council of Orono (hereinafter "City Council") has adopted
subdivision re�lations for the orderly, economic and safe development of land within the City;
and
� WHEREAS, the City Council has considered the application for a subdivision of
a lot line rearrangement by Steven S. Webster and Jo Ellen Webster,husband and wife, and Kent
• Larson and Sandra S. Larson, husband and wife (collectively hereinafter "the applicants") of
properties legally described as:
Lots 1,2,,3, 4, 5,20, 21,22,23, and 24,Block 13,M[innetonka,Bluffs,
Hennepin County,Minnesota � .
(hereinafter "the properties"); and
WHEREAS, the properties consist of two tax parcels, the first being owned by
the Websters and identified as PINS #02-117-23-31-0049, and comprised of Lots 1, 2, 3, 22, 23,
and 24, Block 13, referenced hereinafter as "500 Orono Orchard Road South"; the second being
owned by the Larsons and identified as PINS #02-117-23-31-0005, and comprised of Lots 4, 5,
20 and 21, Block 13,referenced hereinafter as"540 Orono Orchard Road South"; and
WHEREAS, after due published and mailed notice in accordance with Minnesota
Statutes 462.358 et. seq. and the City of Orono Zoning and Planning Codes, the Orono Planning
Conunission held a public hearing on August 21, 2006 at which time a11 persons desiring to be
heard concerning this application were given the opportunity to speak thereon; and
WHEREAS, the applicants have completed or have agreed to complete all
� requirements of the City for a metes and bounds subdivision of a lot line rearrangement for
division and combination purposes, resulting in the relocation of the common lot boundary
between the two parcels, as shown in the survey attached as Exhibit "A" and resulting in a new
: legal description for each parcel as shown in Exhibit"A"; and

WHEREAS, each of the iwo parcels contains an existing single family residence,
and each of the pre-existing parcels is nonconforming as to area and width when compared to the
minimum 2.0 acre/ 200' width standards of the RR-1B Rural Residential Zoning District in
which both parcels are located. As a result of the proposed subdivision and the concurrent alley
vacation, 500 Orono Orchard Road South will decrease from 150' in width to approximately
125' in width and from 0.88 acre in area to 0.85 acre in area; and 540 Orono Orchard Road
South will increase from 100' in width to approximately 125' in width but will increase in area
from 0.59 acre in area to 0.69 acre in area; and
WHEREAS, the adjustment of the common lot boundaxy as proposed will
provide the ability for the Larsons to construct a new driveway accessing directly to Orono
Orchard Road. This will allow removal of Larson's existing driveway across the middle of
Webster's property. The City Engineer has provided comments regaxding the proposed driveway
design; and
• • WHEREAS, as a result of the relocation of the driveway, and upon completion of
the vacation of the alley, City maintenance of the Webster and Larson driveways will cease.
NOW, TIiEREFOI�E, BE IT RESOI,VED, that the City Council of the
City of Orono hereby approves the lot line rearrangement of the above referenced property by
the applicants as shown on the certificate of survey by Mark S. Gronberg, a licensed surveyor of
Gronberg & Associates, Inc. dated June 1, 2006, revised August 1, 2006, as attached in Exhibit
"A", subject to the following conditions:
1. Applicants shall satisfy all recommendations of the City Engineer with regards to
driveway establishment.
2. Approval is subject to the granting of drainage and utility easements as follows and as
shown on the attached Exhibit B:
- 5' wide either side of the revised shared lot boundary between Webster and Larson;
- 5' wide along Larson's south boundary;
- 10' wide along the Larson&Webster frontages abutting the three surrounding roads.
The above easements shall be described by applicants surveyor and dedicated via a
standard easement document.
3. Applicants shall provide to the City a title opinion and certified copies of all.recorded
• easements currently affecting the properties involved in the lot line rearrangement.

4. The aforesaid division shown on the attached Certificate of Survey shall be filed by the
City of Orono with either the Hennepin County Recorder's Office or Registrar of Titles
Office on or before September 25, 2007 together,with a certified original copy of this
resolution.
5. The approval granted by this resolution shall expire if the division has not been filed by
the date specified above. In that event, it will be necessary to file a new application with
the City of Orono for subdivision review.
