RESOLUTION OF THE CITY COUNCIL

A RESOLUTION REGARDING THE METROPOLITAN COUNCIL
" ENVIRONMENTAL SERVICES (MCES) I/I SURCHARGE PROGR.AM
WHEREAS,the Metropolitan Council Environmental Services (MCES)has adopted an
Infiltration/Inflow Surcharge Program, and determined that the City of Orono experienced at
least one peak flow event between June 2004 and June 2006, on September 4, 2005 that exceeds
the MCES peak flow goal for the City, and ' ' �
WHEREAS, the MCES has proposed that the City of Orono pay an annual surcharge of
$89,600 for a period of five years ($448,000 total), or app�eal the proposed surcharge in
accordance with the provisions of the Surcharge Procedure Manual, and
WHEREAS, the Surcharge Procedure Manual further provides five (5) options for
communities to contest the proposed 2007 surcharge amount, including an option for the City to
• corrimit to an Action Plan to spend funds to identify and rehabilitate UI sources in lieu of paying
the proposed surcharge to the MCES as long as the funds expended are equivalent to the
proposed 2007 surcharge amount, and
WHERAS, the MCES will recalculate the 2008-2011 surcharge amounts based on the
City's 2007 expenditures, the results of the sanitary sewer analysis study, and any larger peak
flow events that may occur in the future, and
WHEREAS,Bonestroo Rosene Anderlik has prepared a letter report dated September 6,
2006 that documents the 2006 City expenditures for UI identification and rehabilitation that can
be applied to reduce the proposed surcharge amount, and recommends a comprehensive
approach to study the sanitary sewer system and recommend rehabilitation procedures for
reducing future UI.
NOW THEREFORE BE IT RESOLVED,that:
1. Based on the information provided in the September 6, 2006 Bonestroo Rosene
Anderlik letter report, the City of Orono formally requests that the proposed MCES
UI surcharge amount be reduced by the 2006 UI reduction expenditures already paid
by the City.
2. The City of Orono is committed to an Action Plan as described in the September 6,
• 2006 Bonestroo Rosene Anderlik letter report, to identify sources of the system UI

and subsequently follow up with rehabilitation to reduce the UI as much as possible,
with the intent to meet the MCES peak flow goal.
Adopted by the City Council of the City of Orono, Minnesota, at a regular meeting held
September 11, 2006.
