A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTIONS 78-305 AND 78-1288
FILE NO. 06-3223
WHEREAS, Michael Fey and Stachia Fey, husband and wife (hereinafter
"the applicants") are the owners of the property located at 1570 Long Lake Boulevard
within the City of Orono (hereinafter the "City") and legally described as Lot 10 and the
west half of Lot 9, Albee's Long Lake Addition, Hennepin County, Minnesota
(hereinafter the "property"); and
WHEREAS, the applicants have made application to the City of Orono
• for variances to Orono Municipal Zoning Code Section 78-305 to allow construction of a
new house on a lot that is .34 acres and 102 feet wide when two acres and 200 feet of
width is required and with a front setback of 43 feet when 50 feet is required, 22 and 21
foot side setbacks when 30 feet is required and a 30 foot rear setback when a 50 foot
setback is required.
WHEREAS, the applicants have made application to the City of Orono
for a variance to Orono Municipal Zoning Code Section 78-1288 to allow 36.6 percent
hardcover in the 250 to 500 foot hardcover zone when 30 percent is allowed.
NOW, THEREFORE BE IT RESOLVED by the City Cotmcil of
Orono, Minnesota:
FINDINGS
1. This application was reviewed as Zonin� File 06-3223.
2. The property is located in the LR-lA, Zoning District which requires a
�r_?nimum lot are� of two acres and a minimun�. lot width of tw� hundred
feet.
3. The Plannin� Commission reviewed this application at a public hearing
� held on August 21, and recommended approval of the variances based on
the following findings:

a. The property has an area only 17 percent of the minimum lot area
for the LR-lA zonina district.
b. A house has existed on this property since 1910.
c. No lot adjacent to Lon� Lake Boulevard exceeds one acre in size.
There is no additional land available for the applicants to purchase
to enlarge the property.
d. Because the front lot line is not perpendicular to the side property
lines the usable width of the property is only 84 feet when the
zoning district requires 200 feet. The proposed residence will be
as centered on the property as is reasonably feasible and will not be
out of character�vith the neighborhood.
� e. With a 28 foot reduction in hardcover the total amount of proposed
hardcover equals the total amount of hardcover allowed on the lot.
f. Proposed structural coverage is below the 15 percent limit and will
be conformin�.
4. The City Council has considered this application including the findings
and recommendation of the Planning Commission, reports by City staff,
comments by the applicants and the public, and the effect of the proposed
variance on the health, safety and welfare of the community.
�. The Citv Council finds that the conditions existina on this property are
peculiar to it and do not apply generally to other property in this zoning
district; that granting the variance would not adversely affect traffic
conditions, liaht, air nor pose a fire hazard or other danQer to neighboring
property; �vould not merely serve as a convenience to the applicants, but is
necessary to alleviate a demonstrable hardship or difficulty; is necessary to
preserve a substantial property right of the applicants; and would be in
l:eepina with the spirit and intent of the Zonina Code and Comprehensive
Plan of the Cit��.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants variances to Orono Municipal Zonin� Code Sections 78-30� and 12-1288 to allow
a lot area of.34 acre when two acres is required; a lot width of 102 feet when 200 feet is
required; a front setback of 43 feet when 50 is required; a rear setback of 30 feet when 50
is required; a 22 foot setback from the east property line when a 30 foot setback is
required; a 21 foot setback from the west side property line when a 30 foot setbacic is
required; and 35.3 percent hardcover in the 250 to �00 foot zone when the maximum is
30 percent, subject to the following conditions:
1. Council approval is based on the site plan and house plan submitted by the
applicants and annotated by City staff, attached to this Resolution as Exhibits A
and B. Any amendments to the site plan or house plan which are not in
• confoilnity with City codes will require further Plannin� Commission and City
Council review.
2. Hardcover in the 75-250 foot zone shall be limited to 1,287 s.f. or 19 percent per
the proposed plan and hardcover allowance sunimary as �epicted or� Exhibit �.
Hardcover in the 250-500 foot zone shall be limited to 7,952 s.f. or 32.3 percent
per the proposed plan and hardcover allowance summary as depicted on Exhibit
C. Applicants are advised that any future requests to increase hardcover or
) change the nature of existing/approved hardcover shall require City approval, and
� increases in hardcover will not likely be approved without concurrent reduction in
existing hardcover.
3. As much as possible draina�e fi•om the driveway shall be diverted to a rain garden
or otherwise detained on the property.
�. Applicants shall remove any plastic or fabric liner material from the decorative
landscape beds on the property to ensure their permeability as non-hardcover
surfaces.
�. Required removals of structure and hardcover shall be completed before a
buildinQ permit is issued.

permit for the new construction within one year of the date of Council approval,
or the variance wi11 expire on that date (Au�ust 28, 2007).
7. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zonin� code, shall automatically
terminate any authority �ranted herein, and shall be punishable as a misdemeanor.
8. The undersigned applicants have read, understand and hereby agree to the tetms
of this resolution and on behalf of the applicants and the applicants' heirs,
successors and assigns, hereby agree to the recording of this resolution in the
chain of title of the property.
