A RESOLUTION GRANTING PRELIMINARY
APPROVAL OF A CLASS II SUBDIVISION FOR
PROPERTY LOCATED AT 1135 SPRING HILL ROAD
FILE NO. 06-3219
WHEREAS, Edson Spencer and Harriet Spencer, husband and wife, (hereinafter
the "subdividers") on August 5, 2006, filed a fornlal subdivision application with the City
for approval of a two lot residential plat of property legally described on attached Exhibit
A (hereinafter"the property"); and
WHEREAS, after due published and mailed notice in accordance with Minnesota
Statutes 462.358 et. seq. and the City of Orono's Zoning and Subdivision Codes, the
Orono Planning Commission held a public hearing on August 21, 2006, at which time all
persons desiring to be heard concerning this application were given the opportunity to
speak thereon; and
� WHEREAS, at their regular meeting held on August 28, 2006 the Orono City
Council considered the subdivision application of the subdividers noting the following
findings of fact:
1. The property is located within the LR — lA One Family Lakeshore Residential
Zoning District requiring a minimum of 2 acres of contiguous dry buildable land
within each newly created building lot.
2. The property contains a total of approximately 26 acres of land; approximately 14
acres of which is delineated wetland.
3. The proposed plat consists of two residential lots, each meeting the minimum lot
standard requirements of the LR— 1 A, One Fainily Lakeshore Residential Zoning
District and two unbuildable outlots. Outlot A is wetland. Outlot B is for an
existing private road�vay that serves the properties at 1145, 1245 and 1295 Sixth
Avenue North.
4. A single family residence currently exists within proposed Lot 2. The subdivision
of the property would not create any violations of zoning code regulations for this
house. Proposed Lot 1 is vacant.

5. Proposed Lot 1 will be served with a septic system and private well. Primary and
alternate septic sites ineetiug all pertinent standards have been identified for this
lot.
6. Lot 2 will be served by a septic system or sewer and a private well. An alternative
septic system site meeting all pertinent standards has been identified for this lot.
The existing septic systein is non-compliant and must be replaced before
DeceinUer 31, 2007. Subdivision regulations would require immediate
replacement of the septic system. The applicant proposes that either the property
will be served by sewer or the septic system replaced before Deceinber 31, 2007.
7. Lot 2 will utilize the existing access from Spring Hill Road.
8. Lot 1 and Outlot A will access off the existing private roadway in Outlot B.
� 9. The existing private road�vay is approximately 17 feet wide. The fire code
requires this roadway to be 20 feet wide. The City of Orono subdivision
regulations require this roadway to be 24 feet wide. The Fire Marshall
recommends it be widened to 20 feet.
NOW, THEREFORE, BE IT RESOLVED, that based on the findings noted
above, the City Council of the City of Orono hereby approves the preliminary plat
application of Edson and Harriet Spencer per preliminary plat dra�vings by Mark
Gronberg of Gronberg & Associates, Inc., dated June 20, 2006 and revised August 4,
2006 slibject to the following conditions:
1. The developer shall grant to the City 10 foot drainage and utility easements along
perimeter property boundaries and 5 foot drainage and utility easements along all
interior property boundaries of Lots 1 and 2, a 10 foot drainage and utility
easement adjacent to the County Road 6 fi-ontage of Otttlot A, and a drainage and
tttility easement over all of Outlot B.
2. The subdividers shall execute of a "Declaration of Covenants, Conditions,
Restrictions and Private Roadway Easement" as well as an easement to the City
for road, drainaQe and utilities over Outlot B.

3. Outlot B shall be deeded to the association of property owners that use the
roadway together with a 50 foot easement over Lot 1 to allow creation of a
wetland buffer or provision of a road maintenance agreement acceptable to the
City.
4. Subdividers shall execute a Flowage And Conservation Easement And Restrictive
Covenant For Wetland And Wetland Buffer for the wetlands in Outlot A
5. Lot 2 shall be served by sewer or the septic systein replaced before December 31,
2007.
6. Payinent of standard park dedication fee for Lot 1 at the time of issuance of a
building pennit for a house on the lot.
• 7. Payment of standard stonn water and drainage trunk fee for the plat at the time of
issuance of a building permit for a house on Lot 1.
8. A restoration plan for the slope disturbed by construction of the driveway shall be
required as part of the building permit submission for a house on Lot 1.
9. Subdividers are hereby advised that preliminary subdivision approval will expire
on Au�ust 28, 2007, one year from the date of City Council approval. Should the
subdividers fail to complete the filing of the final plat application within the year
deadline, it shall be necessary for the subdivider to file a new preliminary
subdivision application with the City.
Final Plat Submittals:
The following list of final submittals must be submitted to the Zoning
Administrator two weeks prior to the regularly scheduled City Council meeting on the
second and fourth Mondays of the month. These submittals are as follows:

1. Record plat drawings in the form of two (2) mylar copies (one copy for the City's
records and one for filing with Heruiepin County) and one (1) copy reduced to 1"
=200'. Drawings to include:
a. Lot lines platted per preliminary survey by Mark Gronberg of Gronberg &
Associates, Inc., dated June 20, 2006 and revised August 4, 2006.
b. Dedication of drainage and utility easements 10' wide along the exterior
boundaries of property and 5' along the internal lot lines as noted above.
c. Dedication of a utility easement over Outlot B.
d. Dedication of drainage easements over the delineated wetlands.
e. The name of plat.
• 2. Legal documents required:
a. Title opinion addressed to the City. All owners, mortgage holders or
others with property interest indicated therein shall sign the plat and all
other docuinents affected by such interest.
b. Certified copies of all recorded easements currently affecting the property.
c. Signed and executed Developer's Agreement regarding the provision of
sewer or replacement of the septic system on Lot 2 and widening of the
roadway on Outlot B.
d. Signed and executed Flowa;e and Conservation Easement over the
wetlands and buffer.
3. Fees to be paid: Total due: �530.00

b. Legal review and filing fees for subdivison and associated documents =
