RESOLUTION OF THE CITY COUNCIL

ACCEPTING PUBLIC STREET IMPROVEMENTS
IN THE PLAT OF FOREST ARMS
WHEREAS, the Plat of Forest Arms was approved by the City
Council on February 23, 1970, subject to completion of certain road
and drainage improvements; and �
WHEREAS, on October 26, 1978, the City entered into a written
Agreement with Forest Arms, Inc. (Carol Sue Dongoske and Robert Dongoske) ,
the subdivider-developer, which Agreement provides that Forest Arms, Inc.
would install at no cost to the City the required improvements according
to plans and specifications approved by the City; and further that Forest
Arms, Inc. would provide to the City a Performance Bond guaranteeing
completion of said improvements, and a Warrantee Bond- guaranteeing work-
manship and materials for a period of one year folloc�ing the City' s
acceptance of said improvements; and -
WHEREAS, the public works department has verified satisfactory
completion of all work in accordance with said Agreement,
NOW, THEREFORE, BE IT RESOLVED, that ,the City Council of the
City of Orono hereby accepts the extension of Forest Lake Drive as a
public street, all subject to the terms and conditions of the aforesaid
October 26 , 1978 agreement which provides that Forest Arms Inc. will
warrant and guarantee all materials and workmanship for one vear fr�m
the date of this acceptance. �-
