RESOLUTION OF THE CITY COUNCIL

OF SEWER PROJECT 80-1 �
, WHEREAS, the City of Orono is a municipal corporation organized
and existing under the laws of the State of Minnesota; and
WHEREAS , Sewer Project 80-1 was initiated by the City to solve
existing on-site sewage treatment problems in the Minnetonka Bluffs-West
Fern�ale-County Road 15 (Marina) area in which Windward biarine is
l�ocated; and
WHEREAS , the Windward i►iarine operation, located at 1444 Shorelin�
Drive and Iegally described as PINS No. 11-117-23 22 0006 contains a
marina, retail store, and storage buildinq.
THEREFORE BE IT RESOLVED, by the City Cauncil of the City of
OrQno, that:
1. The above described property known as Windward�Marine is
bene£itted by and shall be assessed for a total .of �wo
sewer units, foz: —
a3 Boat holding tank pumpout. -
b) Commercial Occupancy Building, which use requires
sanitary facilities pursuant to State Building Code
and City marina licensing requirements.
2 . There exists a storage building on the same lot described ,
above (PINS No. 11-117-23 22 0006) but on the East side of
County Road 15 across the highway from the retail sales
building. The Council finds that:
a) •This building is used as an accessory structure for
storage only. There are no existinq sanitary facilitie
No sales or service functions occur in the builfling.
' No persons are regularly employed on the pzemises .
b) Since it is hereby determined to have accessory use
only, said building vill not be asaessed as an occupiec
unit and cannot be hereafter converted to any principa:
c�r other occupancy requirinq sanitary facilities.
c) If the storage buildinq had had sanitary facilities
� or had otherwiae been used for sales, service or
con�nercinl purposea, it would h�ve been assessed
therefore.
� d) A stub for the boat holding tank will be provided .on
the Browns ' Bay (east) side of the road and a stub
for the commercial building will be provided on the
Tanager Lake (west) side of the road.
