RESOLUTION OF THE CITY COUNCIL

DETERMINING THAT THE PROPERTY LOCATED TO THE
EAST OF THE TNTERSECTION OF COUNTY ROAD 15 AND
WEST FERNDALE ROAD WILL NOT BE PROVIDED WITH
SANITARY SEWER AS PART OF THE 80--1 SEj�TER PP,OJECT
WHEREAS , the City of Orona is a municipal co�poration organized
and existing under the laws of �he State of Minnesota; and
WHEREAS, Sewer Project 80�1 was initiated by the City to solve
existing on-site sewage treatment problems in the Minnetonka Bluffs-West
Ferndale area, near which the above referenced property known as part of
Lot l, North Shore Cottage Acres Lake Minnetonka, is located; and
WHEREAS, said property is owned by the Nature Conservancy as
part of its Ferndale Marsh project and is tax exempt at the present
time; and
6�JHEREAS, the Nature Conservancy has stated they have no plans
- to develop, nor any legal way of developing, the property in question
due to deed restrictions placed by the donor of the property, John
Pillsbury; and
WHEREAS, said property consists of approximately 1.3 acres of
which approximately 0. 9 acres is dry land, traversed by a traveled road ,
not on the legal right-of-way; and
WHEREAS, the shape and topography of the lot severely limit
it' s buildability, as do the existing wetlands and roadways ,
THEREFORE, BE IT RESOLVED, by the City Council of the City of
Orono, that the property located to the east of the intersection of
County Road 15 and West Ferndale Road will not be provided with sanitary
sewer and is not intended to be served by the 80-1 sewer project and
this property may not hook up to the public sanitary sewer in th.e future.
Therefore there is no benefit to the property from the construction of
the sewer.
