w`HEREAS, the City of Orono is a municipal corporation arqanized

WFiEREAS, Sewer Pro:ject 80-1 was initiated by the City to solve
existiag on-site sewage treatment problems in the Minnetonka BlU.ffs-West
Ferndale area, within which the fo�lowing legally desaribed property is
located:

The northeasterly 25 feet of the nvrthwesterly 25 feet of
Lot 9 North Shore Cottage Acres Lake Minnetonka; and
WHEREAS, said parcel is under single separate ownership not
owned in cor.tmon with any other abutting or bearby properties; and
WF-IEREAS, all adjacent lots are occupied or are considered as
designated wetlands; and
wIIEFiEAS, the total area of the parcel is approximately 3.0 acre:
of which approxiznately 0. 6 acres is dry bui.ldable land according to all
information the City has available , as compared to the existing zoning
�egulation requiring 2.0 acres per building site; and
WHEREAS , said parcel is not buildable without one or more
variances from the existing zoning code; and
�REAS, construction of a single family residence on the parce:
if •done according to all zoning perfozmance standards, would not be contr�
to the intent of the Community Management Plan; and
WHEREAS , failure to provide se�er service would make the parcel
_ unbuildable because of insufficient room to provide for house, Well, and
primary and future septic system drain£ield; and
W�iEREAS , sewer will be available in the street or right-of-way
adjacent to the property upon completion of sewer project 80-1,

THEREF�RE, B� IT RESOLVED, by �ths City COuncil of t�e City �
of �rono that it is reasonable to provide �ewer service to the property
so as to greserve a substantial property sight of the owner. Sewer
service will be provided to the property, hotirever, providing this 5ewer
service does not in itself constitute qrantit�g of any zoning variances
which may be required now or in� the f4ture to germit' construction an the
1ot which variances if appl.ied for shall be reviewed on �their own merits
and �ircumstances at that time.
