RESOLUTION OF THE CITY COUNCIL

DECLINING TO VACATE UNIMPROVED STREET AND
PARK PROPERTY IN THE PLAT OF SAGA HTLL REVISED
WHEREAS, the City of Orono, hereinafter "City" , is a
municipal corporation organized and existing under the laws of the
State of Minnesota; and
WHEREAS, the City has received a request from Fred Ryan
and Glen Carlson to vacate in their favor certain unimproved public
property at the intersection of Park Drive and North Arm Drive,
described as the "Park" platted at that intersection and that portion
of platted, unimproved Lafayette Avenue (now Park Drive) lying west
of the "Park" and adjacent to Lots 6, 7 , 8 & 9, Block 7, Saga Hill
Revised, as shown on attached Exhibit A; and
WHEREAS , pursuant to said request and in accordance with
Section 32. 700 of the Orono Zoning Code and Minnesota Statutes Section
412 . 851, a Public Hearing was held by the Planning Commission on
April 21, 1980, during which hearing testimony was given by at least
- five neighbors regarding current public use of the area by neighborhood
children and their resulting opposition to vacating the property; and
WHEREAS, a review by the Orono Park Commission on May 6, 1980,
resulted in a recommendation to retain the park land and combine it
with the adjacent unused public right of way to create a more feasible
neighborhood park area; and
WHEREAS, the identification and limited development of small
neighborhood play areas is consistent with the policies contained in
the 1980 Community Management Plan, particularly when no new land
acquisition is necessary; and
WHEREAS, the arguments in favor of vacation centered mainly
on complaints of limited maintenance of the area and on noisy and
unauthorized vehicular use of the area, the control of which would be
improved if the area were better defined as publicly owned property.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Orono hereby refuses and declines to approve vacation of
' the above referenced public property, finding no public purpose to be
served by such vacation, but on the contrary, finding a current and
ongoing public use of the property which justifies eontinued public
ownership and control.

In making the above finding, the City Council specifically makes no
promises or plans to improve, develop or upgrade the property in any
way, and specifically makes no promises to maintain the property to
any standard other than the minimum maintenance level's afforded other
unimproved parcels of public property, except as follows:
1. The City will and hereby does request Hennepin
• County to place traffic control posts along North
Arm Drive, County Road 151, in order to prohibit
unauthorized driving of vehicles across the property
thereby protecting the safety of persons using the area.
2 . The City Council, consistent with conceptual direction
given July 14, 1980, hereby approves and orders City
installation of traffic control posts along Park Drive
for the same purpose stated above.
Adopted by the City Council of the City of Orono on the
28th day of July , 1980.
