RESOLUTION OF THE CITY COUNCIL

� � � A RESOLUTION APPROVING LOT AREA, LOT WIDTH
AND SETBACK VARIANCES FOR STEVEN CURREN
WHEREAS, the Planning Commission and Council have reviewed
a request by Steven Curren to remodel and add on to his residence
located at 110 Orono Orchard Road; and
WHEREAS , said proposal involves major construction requiring
review of minimum lot area, setback standards and septic requirements;
and
WHEREAS , Steven Curren has app�.ied for variance from all
applicable City Zoning Ordinances,
NOW, THEREFORE, BE IT RESOLVED, that based upon Planning
Commission and City Staff research, the City Council hereby makes the
following findings of fact:
l. The lot is a single, separately owned parcel of land
containing 16,500 square feet of area, located in the
RR-1B Rural Residential District which district requires
2 acres (87 ,120 square feet) of land per residence.
Variance requested 70, 620 sq. ft. = 81� .
2 . The lot is approximately 110 feet wide at the building
site compared to the RR-1B District requirement of 200 feet.
Variance requested 90 feet = 45$
3. The proposed addition will be located 28 feet from the
rear property line, the RR-1B District requires a 50 foot
setback. Variance requested 22 feet = 44� .
4 . The proposed addition will be located 25 feet from the
` southeast side property line, the RR-1B District requires
a 30 foot setback. Variance requested 5 feet = 17� .
5. The improvement to the existing one bedroom structure
will create an additional bedroom requiring expansion of
existing drainfield. The On-Site Manager affirms there
is adequate area for required drainfield expansion. The
drainfield will be setback 50 feet from the. existing well;
the septic code requires a 75 foot separation. Variance
requested 25 feet = 33 1/3$.

6. The special conditions applying to the structure or
land in question are peculiar to such property or immediately
surrounding property and do not apply generally to other
land or structures in the district in which said land is
located. ,
7. The granting of the application is necessary for the
preservation and enjoyment of a substantial property right
, of the applicant.
8. The granting of the proposed variance will not in any
way impair the public health, safety, comfort, morals or
general welfare.
9. The granting of the proposed variance will not be
contrary to the intent of the Comprehensive Land Use Plan
or the Zoning Code.
10. The granting of such variance will not merely serve as
a convenience to the applicant, but is necessary to alleviate
demonstrated hardships or difficulties resulting from the
location of the existing house on the lot.
FURTHERM�RE, BE IT RESOLVED, that based upon the foregoing
findings, the City Council hereby approves the lot area, lot width
and setback variances as requested subject to the following conditions:
1. Applicant must complete the following requirements before
the City will issue a Certificate of Occupancy:
a) removal of existing, detached garage
b) improvement and addition to existing drainfield �
to be completed.
2. Al1 construction shall be subject to the requirements
of the State BuildinQ Code.

3. The approvals granted by this Resolution will expire
if permits are not received and work commenced on or before
July 14, 1981, in which case a new application must be
submitted.
Adopted by the City Council of the City of Orono on the
14th day of July , 1980.
