RESOLUTION OF THE CITY COUNCIL

A RESOLUTION CALLING FOR PREPARATION OF PLANS FOR
NORTH SHORE DRIVE-SCOTCH PINE LANE SANITARY SEWER PROJECT
WHEREAS , the City of Orono is a municipal corporation organized
and existing under the laws of the State of Minnesota; and
WHEREAS , Resolution No. 1121 of the City Council, adopted the
� 25th day of February, 1980, documented the need for upgrading sewage
treatment and disposal facilities in the North Shore Drive-Scotch Pine
Lane area, and called for a feasibility study for the installation of a
municipal sanitary sewer collection system to serve the area; and -
WHEREAS , this feasibility study was received by the Council on
April 28, 1980, which study indicated that construction of a municipal
sanitary sewer collection system was feasible at an estimated cost of
$153, 800 for a routing requiring easements through the properties, or
$182 ,228 for a routing along city and county rights-of-way.
i- WHEREAS , each property owner in the study area was sent a
questionnaire asking for a response indicating whether or not they favored
the installation of sanitary sewers; and
WHEREAS, two-thirds of the property owners indicated they were
in favor of municipal sanitary sewers, and that of these, all were in
favor of a routing through the properties , which would require easements
to the City; and
WHEREAS , Resolution No. 1142 of the City Council, adopted the
28th day of April , 1980, fixed a date for a Public Hearing on the proposed
improvement of portions of North Shore Drive and Scotch Pine Lane, by
installing municipal sanitary sewers; and
WHEREAS , ten days published notice of the Hearing through two
weekly publications of the required notice was given and the Hearing was
held thereon on the 21st day of May, 1980, at which time all persons
desiring to be heard were given an opportunity to be heard thereon; and
WHEREAS, a number of the properties whose owners indicated
they favor continuing with on-site systems, have existing systems which
cannot easily be replaced or repaired within the confines of State and
local regulations; and

WHEREAS, the existing conditions are causing pollution of the
ground and surface waters and creating a distinct and direct hazard to
the public health and safety; and
WHEREAS, these hazardous conditions can be alleviated by
construction of a municipal sanitary sewer collection system, which
public improvement project must be undertaken according to the laws
of the State of Minnesota, and may include financing by means of
assessment of all or a portion of the costs of the improvement to
the benefited properties, pursuant to Minnesota Statutes Chapter 429 ,
NOW, THEREFORE, BE IT �RESOLVED, by the City Council of the City
of Orono, Minnesota, pursuant to Chapter 429, Minnesota Statutes, does
hereby order Bonestroo, Rosene, Anderlik & Associates, Inc. , City Engineers,
to prepare plans and specifications for the improvement of the North Shore
Drive-Scotch Pine Lane area municipal sanitary sewers.
Adopted by the City Council of the City of Orono, Minnesota,
this 2 day of June , 1980 .
