BOARD OF REVIEW INFORMATION
Definitions and Explanations
Powers of the Local Board of Review: The board may only increase or decrease the market value and/or
change the classification of any properties on an individual basis. The board may also add any properties that
were omitted from the tax rolls. These changes can only be made for the January 2, 1995 assessment/1996 tax
year.
Limitations of the Local Board of Review; The board may make no aggregate changes to the entire
assessment and it is limited to indivdual changes not to exceed 1% of the total market value of the city.
Market Value: The most probable price in terms of money which a property should bring in a competitive and
open market under all conditions requisite to a fair sale, the buyer and seller, each acting prudently,
knowledgeably and assuming the price is not affected by undue stimulus.
Classiflcation: The use of a property as defined by Minnesota Law. The most common classifications are
apartment, double bungalow, triplex, commercial, farm, industrial, seasonal recreational, residential homestead,
and residential non-homestead.
Limited Value: A stamtory value that is automatically calculated when the market value of a property is
increased over 10%. This value can increase either 10% each year or 1/3 of the difference between the current
and previous years' values if that difference is greater than 30%.
Qualifying Improvements: Used to describe the amount of an improvement under the "this old house" law.
This law allows homeowners of property at least 35 years old (and under $150,000 except in Excelsior,
Hopkins, and Minneapolis which have a $300,000 limit) at the time a permit is applied for to apply and have
certain improvements exempted from taxation for 10 years.
Taxable Market Value: This is the net value used for taxation. It is the market or limited value, whichever is
lower, minus the qualifying improvements. Remember, that not every property will have a limited value or a
qualifying amount.
MOST ASKED QUESTIONS
Why does my market value keep increasing each year? Because properties in your city are in demand in the
real estate marketplace. When values decline it is usually because that market has become undesirable.
W,. It if I think another property is undervalued? You may request, in writing, that the local board of
review have the assessor review that property. The board is required to notify the property owner and then to
direct the assessor to review the property.
Isn't the assessor ’s value supposed to be lower than the actual value of a property? Miimesota State Law
states that all properties are required to be valued at Market Value. As a practical matter the Miimesota
Department of Revenue and the Hennepin County Assessor's Office require the median sale in a city to be at
93%; thus one half of the sales are above and the other half are below this point.

Why isn't my value set at 93% of market value? The 93% median sales ratio is a check, done after the
assessment has been completed, to determine if the assessment was correctly done. Your property was valued
on the basis of its location, size, quality and amenities.
Why can't the assessor just raise the values of the properties that have sold and leave my value alone?
The law states that all properties, not properties that have recently sold, be valued at market value. In addition
the State of Minnesota and Hennepin County check the amount the local assessor increases the properties that
have sold, the amount of increase of a random sample of all properties of the same classification and the total
increase of each property type. If these figures do not correspond, the State or County will increase the entire
assessment of that property classification.
My house is worth much more than the average house in the area, but I don't get any more services than
the average homeowner does. Why? By law Minnesota has an Ad Valorem Real Estate Ta.x or a tax based
on the value of your house, but each property owner is entitled to "equal benefits" under Federal and State Law.
I'm on a fixed income and I am being taxed out of my house! What can I do? The only current relief is the
income adjusted homestead credit which targets seniors and low income homeowners and renters. .Apply with
form Ml PR directly to the State of Minnesota.
How can I change the way property taxes are determined? By contacting your State Senator and State
Representative. All real property tax laws are legislated by them.
When is it all going to end? It will change when and if the law changes. These changes have to be made at
the state level.

Our home at above address does not have a value of $299,700 as proposed in our
notice of 1995 value for real estate taxes payable in 1996.
Based on our calculation it has a value less than $266,000. This estimate
is based on;
► the purchase price of the home
► the deterioration of the home since purchase
► the rate of inflation
► the market value of a home sold nearby of greater square footage, more
lakeshore and better exposure
► the limited value of the property
► the limited shoreline and restrictions on property

Summary
The property at 2610 Mapleridge Lane is overvalued for purposes of taxes at the
Estimated Market Value of $299,700. The value is more approximately placed in the
range of $265,000.
There is a history of inappropriate valuation of this property. The house is small and
in only fair condition, the property is narrow and encumbered, and nearby properties
are valued at less for more.
The owners, Greg and Jackie Gerard, therefore petition the Local Board of Review to
lower the Estimated Market Value to $265,000 as the 1995 value for taxes payable in
1996.

What we received the notice of the real estate valuation for our home April 19. 1995. we called
the assessor’s office Records for .sales of three properties on Shadywood Road and one on
Baldur Park Drive were sent to us, however, we were told they do not have records of sales on
property that is comparable to ours. These properties that were sold all have SO feet of shoreline
and ours has 38. Also, we are across the street from commercial property, a busy gas station and
Lord Fletcher’s Restaurant. These two items alone should substantially reduce the value of our
property compared to those of the residential sales sent to us. Also, there have been no
improvements made on our property during the past six years, ya the valuation has been
increased $35,000
We do not feel any increase in the value of our property is justified and request that it be left
where it is.

increase ip value of my home by over $38,000.00 to $403,700 from $373,000 in 1994 and
$367,000 in 1993.
This is clearly unreasonable. The basement remains unfinished and no major
improvements have been made to this property.

Lake has been dedicated to the orono Conservation District for natural
wildlife habitat. This shoreline cannot be used for recreation, nor
will trees be cut, nor a dock built, etc.

Unfortunately, I am going to be out of town April 26 so I cannot appear
in person therefore, I am writing you this letter.
When we moved into our house in 1991, after we remodeled, the market
value was $353,700 which reflected a steep increase, obviously because
of the remodeling.
In 1994 the taxes were based on $365,000 or a 3.2% increase which is
reasonable and equal to inflation. In 1995 we received notification
that the value had increased by $26,500 or 7.3%, which is well over
the 3% average inflation. In talking to your Assessor, Mr. Haller,
this is reasonable because of houses that have been sold on Fox Ridge
Road (which is one of the hottest areas in Orono) and therefore justify
that we increase our property taxes by $26,500.
I want to protest this. The burden of property taxes keep on piling
up. If it is tied onto the inflation, I have no problem with that.
What property is selling for depends a great deal on the area, when
the house was built, etc.. Mind you, our house was built in 1950 with
some remodeling and updates.
I would like you to consider this at your meeting and let me know what
I need to do.

This letter is to protest and appeal the 1995 evaluation of $164,000 for our
property. We do not feel it is accurate or appropriate for our property which has not been
improved since our purchase. We paid much less for this property only a few years ago.
We do not feel this new valuation resulting in a 10% increase of taxable value is correct
for an existing older home, (138,000 to 151,800).
When we purchased our property the tax value was much higher than what was
actually paid for it. We were successful in receiving a reduction in the tax value at that
time; however, we feel this current evaluation is an attempt in the same direction as the
previous incorrect tax valuation. It is not appropriate or fair to use the much higher values
of the newer much larger homes and much more elaborately built homes that have been
constructed during the last few years in Orono to inappropriately increase the valuation of
the older smaller basic homes.
We have called the assessor for justification of the increased valuation. We have
not yet received a reply. We will not be able to be present for the April 26, 1995 hearing
and we wish this letter to be our appeal and response to the Valuation Notice.
Please notify us in writing of the results of this meeting and what our appeal options
are if this appeal is not in our favor.

I am unable to be at the local Board of Review meeting scheduled for April 26,1995 at
7:00 p.m. at the Orono Council Chambers.
I am contesting the estimated market value of $340,000 for the 1995 Value For Taxes
on the above property The most current appraisal of our property was made on
November 22.1993 at a value of $309,000 (see enclosed copy of this appraisal). The
Orono City Appraiser/Assessor was provided with a copy of this appraisal in April 1994.
At that time, the 1994 value was set at $328,000. (See copy of 19^ Valuation Notice
enclosed.)
After review by the City Assessor, the $328,000 was reduced to $308,200. (See
enclosures dated April 27, 1994 and May 5,1994.) I have also enclosed a copy of my
letter to the Orono Board of Review dated April 25, 1994,
Once again, I find if very difficult to understand how the estimated value of property eau
increase from $308,200 as of January 2, 1994 to $340,000 in April 1995. In 1994,
Property Value For Taxes increased from $303,500 to $328,000. In 1995, Property
Value for Taxes increased from $308,200 to $340,000.
Based on the appraisal value of November 23,1993, there is no justification for this
increase of $31,800

I wish to appeal my hrane valuation for 1996. This valuation has
increased 16% over two years and I think this is extremely excessive.
A ootiparison with three other lakeshore homes of similar quality
reveals a selling value of approximately $187,500 (average of the
three).
Please note the lakeshore homes I've attached which are taxed from
$3700 to $4100. (Your proposed valuation would bring my taxes up to
about $4100). These hones sold from $215,000 to $320,000, while my heme
would sell for about $187,500.
Please reconsider your tax increase proposal. I think it's
very excessive for my property and the enclosed cotparables and other
lakeshore homes illustrate how inappropriate an increase such as proposed
is for this property.
