HomeMy WebLinkAboutResolution 1145 r .<- f RESOLUTION #114� A RESOLUTION CALLING FOR PREPARATION OF PLANS FOR MINNETONKA BLUFFS - COUNTY ROAD 15 - WEST FERNDALE- ORONO LANE SANITARY SEWER PROJECT WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, Resolution #1080 of the City Council, adopted the Sixteenth day of October, 1979 , documented the need for a municipal sanitary sewer collection system for the Minnetonka Bluffs - County Road 15 - West Ferndale - Orono Lane area, and called for a feasibility study for the project; and WHEREAS, this feasibility was received by the Council on February 25 , 1980 , which study indicated that construction of a municipal sanitary sewer collection system was feasible at an �stimated cost of $937, 280 . 00 for a gravity-flow system or _ $558 ,200 .00 for a combined gravity and pressure-flow system, and WHEREAS, Resolution #1120 of the City Council, adopted the Twenty-fifth day of February, 1980 , f ixed a date for a Public Hearing on the proposed improvement of portions of County Road 15 , Orono Lane , West Ferndale Road, Fox Street, Dickenson Street, Orono Orchard Road South, Barrett Avenue, Hanlon Avenue, Keene Avenue, and Russell Avenue, by installing municipal sanitary sewers; and WHEREAS, ten days published notice of the Hearing through two weekly publications of the required notice was given and the Hearing was held thereon on the Twentieth day of March, 1980 , at which all persons desiring to be heard were given an opportunity to be heard thereon; and WHEREAS, questionnaires were subsequently sent to owners of all property which might benefit from the project, which questionnaires indicated to each property owner the estimated assessment to the property, and asked for a response indicating whether the owner was in favor of municipal sewer, and if so, which alternative, or in favor of continuing with on-site sewage treatment systems; and , � '^ G, . . � Resolution #1145 , Page 2 WHEREAS, the responses to the questionnaires indicated that a majority of those responding overall were in favor of installation of municipal sanitary sewer; and WHEREAS, a number of the properties whose owners indicated they favor continuing with on-site systems, have existing systems which cannot feasibly be replaced or repaired within the confines of State and local regulations; and WHEREAS, the existing conditions are causing pollution of the ground and surface waters and creating a distinct and direct hazard to the public health and safety; and WHEREAS, these hazardous conditions can be alleviated by construction of a municipal sanitary sewer collection system, which public improvement project must be undertaken according to the laws of the State of Minnesota, and may include financing by means of assessment of all or a portion of the costs of the improvement to the benefitted properties, pursuant to Minnesota Statutes Chapter 429 . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orono, Minnesota, pursuant to Chapter 429, Minnesota Statutes, does hereby order Bonestroo, Rosene, Anderlik & Associates, Inc. , City Engineers, to prepare plans and specifications for the improvement of the Minnetonka Bluffs - County Road 15 - West Ferndale - Orono Lane area municipal sanitary sewers.
