RESOLUTION OF THE CITY COUNCIL

A RESOLUTION APPROVING LOT AREA, LOT WIDTH
AND HARDCOVER VARIANCE FOR STEVEN TIBBETTS
WHEREAS, the Planning Commission and Council have reviewed
a request by Steven Tibbetts to remodel and add on to his existing
residence located at 1998 Shadywood Road; and
WHEREAS, said proposal involves major construction requiring
review of minimum lot area standards, lot width standards and hardcover
requirements; and
WHEREAS, Steven Tibbetts has applied for variances from all
applicable City zoning ordinances.
NOW, THEREFORE, BE IT RESOLVED, that based upon Planning
Commission and City Staff research, the City Council hereby makes
the following findings of fact:
l. The lot is a single, separately owned parcel of
land containing 7, 276 square feet of area, located in
the LR-1C Single Family Lakeshore Residential District
which district requires � acre (21,780 square feet) of
land per residences: Variance requested 14,504 square feet=
67g.
2. The lot is approximately 50 feet wide at the building
site compared to the LR-1C District requirement of 100 feet:
Variance requested 50 feet=50$.
3. The existing house and garage hardcover of 1, 502 square
feet is 19� greater than the allowed amount for the subject
lot. The proposed construction will result in a 16$ increase
from existing, which increase is to be compensated by
improved drainage and erosion control: Total Variance
requested 1,205 square feet of hardcover or 35� .
4. The northeast corner of the existing structure encroaches
20 feet into the lakeshore setback area. The proposed construction
will decrease the setback from the lake by approximately
2. 5 feet.
5. The proposed construction provides for a new foundation
to be elevated 2 feet above grade and eliminate flooding
or flood damage to home caused by drairiage along an adjacent
public alley.

4 . The approvals granted by this Resolution will expire
if permits are not received and work commenced on or before
March 24 , 1981, in which case a new application must be•
submitted.
Adopted by the City Council of the City of Orono at their meeting on
the 24th day of March , 19 80

6. The special conditions applying to the structure or
land in question are peculiar to such property or immediately
surrounding property and do not apply generally to other
land or structures in the district in which said land is
located. '
7. The granting of the application is necessary for the
preservation and enjoyment of a substantial property right
of the applicant.
8. The granting of the proposed variance will not in any
way impair the public health, safety, comfort, morals or
general welfare.
9. The granting of the proposed variance will not be
contrary to the intent of the Comprehensive Land Use Plan
or the Zoning Code.
10. The granting of such variance will not merely serve as a
- convenience to the applicant, but is necessary to alleviate
demonstrated hardships or difficulties resulting from the
location of the existing house on tYie lot.
FURTHERMORE, BE IT RESOLVED, that based upon the foregoing
findings, the City Council hereby approves the lot area, lot width and
hardcover variance as requested subject to the following conditions:
1. The new construction must maintain the side yard setbacks
of the existing house; north side yard setback of 10 feet
and south side yard setback of 8.7 feet. -
2. The Applicant shall sign this resolution and thereby
agree that the proposed removal of a 2 . 5 ft. by 21. 7 ft.
section of the house that encroaches the 75 ft. lakeshore
setback area must be completed no later than July 1, 1981,
or this Variance shall be automatically void, regardless of
the amount of other work actually accomplished by that time.
3. Al1 construction shall be subject to the requirements of
the State Building Code.
