A RESOLUTION ORDERING A FEASIBILITY STUDY FOR
NORTH SHORE - SCOTCH PINE SEWAGE TREATMENT PROJECT
WHEREAS, the City of Orono is a municipal corporation organized
and existing under the laws of the State of Minnesota; and
WHEREAS, for the purpose of protecting the public health and
safety and for promoting the most general public welfare, the City has
adopted Ordinance No. 210, The On-Site Sewage Treatment Code, which
ordinance regulates the proper design, location, construction, alteration,
use and maintenance of on-site sewage treatment systems, and which
ordinance established a program for inspection of existing on-site systems
to assure a minimum, adequate level of sewage treatment in the City; and
WHEREAS, this inspection program has identified a definable
neighborhood in the City termed "North Shore Drive - Scotch Pine Lane
Area" including the properties shown on the attached map (Exhibit A)
which has a significant percentage of on-site sewage treatment systems
which do not conform to the minimum requirements of Ordinance No. 210,
which are not performing an adequate level of sewage treatment, and
for which reconstruction to minimum standards is costly and/or impossible
due to poor soil, high water table or small lot size; and
WHEREAS, the above described condition is causing pollution of
the ground and surface waters and a distinct and direct hazard to the
public health and safety requiring remedial efforts by the property
owners involved, which effort will most likely require public coordination
by the City in the form of a public improvement project; and
WHEREAS, on January 8, 1980, the City Council held an
informational meeting to which all the property owners in the affected
neighborhood were invited, and at which meeting the existing sewage
treatment problems were discussed together with various options available
for correction of the problems; and
WHEREAS, a consensus of opinion at this meeting was that there
are certain sewage treatment problems in the neighborhood which could
likely not be solved on individual lots by individual property owners;
and
WHEREAS, a further consensus of opinion at this meeting was
that a likely alternative solution to the problem is construction of a
sewage collector system culminating in a connection to the Metropolitan
- Waste Control Commission Interceptor Sewer running through the area; and

WHEREAS, the City Council desires to assist the property
owners of the neighborhood in the efficient, economical, practical and
successful solution of their sewage treatment problems, which assistance
may culminate in the construction of a sanitary sewer collection system
in the neighborhood; and
WHEREAS, a sewage treatment project is currently under
consideration for the Minnetonka Bluffs - West Ferndale Area of Orono,
and it is likely that a sewage treatment project for the North Shore -
Scotch Pine Area could be constructed at less expense to the property
owners involved if bid concurrently with the Minnetonka Bluffs - West
Ferndale Project.
WHEREAS, any public improvement project of this sort must be
undertaken according to the laws of the State of Minnesota, and may
include financing by means of assessment of all or a portion of the
costs of the improvement to the benefited properties, pursuant to
- Minnesota Statutes Chapter 429,
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the
City of Orono hereby orders and instructs the City Engineer to study
the proposed improvement project and to report to the Council with
all convenient speed advising the Council in a preliminary way as to
whether the proposed project is feasible and as to whether it should
best be made as proposed or in some other manner, and the estimated
time of completion and cost of the improvement as recommended, which
report should include at least the following information:
l. Proposed sanitary sewer lateral location.
2. Location of pumping station or stations.
3. Proposed location and method of service hookup each lot.
4. Total project cost.
5. Proposed assessment area.
6. Assessment alternatives.
7. Estimated cost per unit.
8. Estimated cost for service hookup. �
9. Feasibility of proposed project.
